CONTENT

 

The bill would amend the Public Health Code to allow the Department of Licensing and Regulatory Affairs (LARA) to increase fees and impose late fees on registrations for nurse aides and medications aides.

 

The Code requires an applicant for registration to practice as a nurse aide or a permit to conduct training or instruction of a nurse aide candidate, or renewal of that registration or permit to pay biennial fees. The bill would allow LARA to increase the imposed fees and also to impose a late fee.

 

Under the bill, if an application for renewal of a registration to practice as a nurse aide or for renewal of a permit to conduct training or instruction of a nurse aide candidate were received by LARA after the registration or permit expired, the applicant would have to pay a $75 late fee in addition to the renewal fee.

 

At the beginning of each State fiscal year, the Department could increase the fees collected under the bill by a percentage amount not exceeding the average percentage wage and salary increase granted for that fiscal year to classified civil service employees employed by LARA.

 

If the Department increased these fees, the increase would be effective for that fiscal year and the Department would have to use the increased fees as the basis for calculating fee increases in subsequent fiscal years.

 

By August 1 of each year, the Department would have to provide to the Director of the Department of Technology, Management, and Budget and the chairpersons of the House and Senate Approprations Committees a complete schedule of fees to be collected under this section for the following fiscal year.

 

The Act also requires an individual to hold a registration to practice as a medication aide to engage in practice as a medication aide.

 

If an application for renewal of such a registration or for renewal of a permit to conduct training or instruction of a medication aide candidate were received by the Department after the registration or permit expired, the applicant would have to pay a $75 late fee in addition to the renewal fee.

 

At the beginning of each State fiscal year, the Department could increase the fees collected under the bill by a percentage amount equal to not more than the average percentage wage and salary increase granted for that fiscal year to classified civil service employees employed by LARA.

 

 

If the Department increased fees under the bill, the increase would remain effective for that fiscal year. The Department would have to use the increased fees as the basis for calculating fee increases in subsequent fiscal years.

 

By August 1 of each year, the Department would have to provide to the Director of the Department of Technology, Management, and Budget and the chairpersons of the Senate and House Appropriations Committees a complete schedule of fees to be collected under the bill for the following fiscal year

FISCAL IMPACT

 

The bill would have a positive fiscal impact on State government and no fiscal impact on local government. The total impact is indeterminate and would depend on the number of facilities on which the Department would levy the fees.
