SENATE BILL NO. 989
A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 147d.
the people of the state of michigan enact:
Sec. 147d. (1) Except as provided in subsections (2) and (3), a person, acting under color of any law, that for any reason willfully subjects an individual to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution of the United States, the state constitution of 1963, the laws of this state, or the laws of the United States, or to different punishments, pains, or penalties than are prescribed for the punishment of other individuals, is guilty of a misdemeanor punishable by imprisonment for not more than 1 year, a fine of not more than $1,000.00, or both.
(2) Except as provided in subsection (3), if a violation of subsection (1) causes bodily injury or if the violation of subsection (1) includes the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, the person is guilty of a felony punishable by imprisonment for not more than 10 years, a fine of not more than $5,000.00, or both.
(3) If the violation of subsection (1) causes a death or if the violation of subsection (1) included acts amounting to kidnapping or attempted kidnapping, criminal sexual conduct or attempted criminal sexual conduct, or murder or attempted murder, the person is guilty of a felony punishable by imprisonment for life or any term of years, a fine of not more than $50,000.00, or both.
Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
