HOUSE BILL NO. 5580
A bill to amend 1976 PA 388, entitled
"Michigan campaign finance act,"
(MCL 169.201 to 169.282) by adding section 29a.
the people of the state of michigan enact:
Sec. 29a. (1) Except as otherwise provided in this section, a 527 organization or a 501(c)(4) organization shall electronically file a registration with the secretary of state no later than 10 days after the organization becomes a 527 organization or 501(c)(4) organization under section 7.
(2) A registration under this section must contain all of the following information:
(a) The name of the organization.
(b) The name of the individual who is employed by, is on the board of, or directs or controls the organization under section 7(4) or (5).
(c) If an individual under subsection (2)(b) is not an elected official or candidate for state elective office, the name of the elected official or candidate for state elective office of whom the individual is an employee, contract employee, staff member, or family member.
(3) The secretary of state shall post on the secretary of state's website the information filed with the secretary of state under this section.
(4) This section does not apply to any of the following:
(a) House political party caucus committees.
(b) Senate political party caucus committees.
(c) Political party committees.
(5) If a 527 organization or 501(c)(4) organization has a balance of $10,000.00 or less and fails to register with the secretary of state under this section, the organization is responsible for a state civil infraction and may be ordered to pay a civil fine of not more than $1,000.00.
(6) If a 527 organization or 501(c)(4) organization has a balance of greater than $10,000.00 but less than $20,000.00 and fails to register with the secretary of state under this section, the organization is responsible for a state civil infraction and may be ordered to pay a civil fine of not more than $4,000.00.
(7) If a 527 organization or 501(c)(4) organization has a balance of $20,000.00 or greater and fails to register with the secretary of state under this section, the organization is responsible for a state civil infraction and may be ordered to pay a civil fine of not more than $5,000.00.
(8) If a 527 organization or 501(c)(4) organization fails to register with the secretary of state under this section, the elected official or candidate for state elective office who must be reported under subsection (2)(b) or (c) is responsible for a state civil infraction and may be ordered to pay a civil fine of not more than $1,000.00.
Enacting section 1. This amendatory act takes effect January 1, 2026.
Enacting section 2. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 5582 (request no. 00454'23 *) of the 102nd Legislature is enacted into law.
