HOUSE BILL NO. 4801
A bill to regulate persons that provide electric vehicle charging services; to require registration of certain persons that provide electric vehicle charging services; and to prescribe the powers and duties of certain state officers and entities.
the people of the state of michigan enact:
Sec. 1. This act shall be known and may be cited as the "electric vehicle charging services registration act".
(a) "Department" means the department of agriculture and rural development.
(b) "Electric vehicle" means that term as defined in section 2(f)(iii) of the Michigan next energy authority act, 2002 PA 593, MCL 207.822.
(c) "Electric vehicle charging services" means the transfer of electric energy from electric vehicle service equipment to a battery or other storage device in an electric vehicle, and the provision of billing services, networking, and operation and maintenance related to that transfer of electric energy to an electric vehicle.
(d) "Electric vehicle charging station" means an electric component assembly or cluster of component assemblies designed specifically to charge batteries within an electric vehicle by permitting the transfer of electric energy to a battery or other storage device in an electric vehicle.
Sec. 3. (1) The department shall allow a person that provides electric vehicle charging services to charge for providing electric vehicle charging services.
(2) Subject to subsection (8), the department shall issue orders establishing a registration procedure for persons that provide electric vehicle charging services. Subject to subsections (5) and (8), any person offering electric vehicle charging services in this state must register with the department within 30 days after the person first begins offering electric vehicle charging services in this state. As part of a person's registration, the department shall require that the person offering electric vehicle charging services does all of the following:
(a) Provides the name of the company that will be providing electric vehicle charging services.
(b) Provides the location of each of that person's electric vehicle charging stations in this state and the number of electric vehicle charging stations.
(c) Provides the name, electronic mail address, phone number, and mailing address of a designated contact individual.
(d) Provides the electric vehicle charging station model information, including name of manufacturer, electric vehicle supply equipment type, and additional information regarding the charging station as determined by the department.
(3) The department may charge a 1-time fee of not more than $75.00 for each person that registers under subsection (2). Any fees collected under this subsection must be deposited in the general fund to the credit of the department to be used for the department's costs for oversight and registration of persons that provide electric vehicle charging services.
(4) A person that provides electric vehicle charging services shall do all of the following:
(a) Maintain records that the department considers necessary, including, but not limited to, installation and maintenance of electric vehicle charging stations.
(b) Remain accessible to the department, to consumers, and to electric utilities in this state during normal hours of operation.
(c) Clearly display the cost to the consumer at the charging station. This subdivision does not prohibit a person that provides electric vehicle charging services from displaying other information to the customer or the means by which the cost information is displayed, including, but not limited to, within the electric vehicle or on a mobile application.
(5) A person providing electric vehicle charging services before the effective date of this act must register with the department within 90 days after the department establishes a registration under subsection (2).
(6) A person registered under subsection (2) shall update their registration by notifying the department, in a manner determined by the department, within 30 days after any of the information required in subsection (2) has changed.
(7) The department shall use the motor fuels quality hotline or a similar hotline and an online consumer complaint form to allow consumers to report issues with electric vehicle charging stations.
(8) This section does not apply to any of the following:
(a) A private owner of an electric vehicle charging station or a nonretail provider of an electric vehicle charging station if the electric vehicle charging station is not publicly accessible or if that private owner or nonretail provider will provide electric vehicle charging services at no cost to users of the electric vehicle charging station.
(b) An electric utility.
(c) A municipally owned electric utility.
(d) A cooperative electric utility.
(e) An independent transmission owner.
(9) The department may promulgate rules under the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328, necessary to implement and enforce this act.
Enacting section 1. This act does not take effect unless Senate Bill No.____ or House Bill No.4802 (request no. 00383'21) of the 101st Legislature is enacted into law.
