ELECTRONIC TRANSMISSION OF RX; EXCEPTIONS H.B. 4659:
SUMMARY OF BILL
REPORTED FROM COMMITTEE
House Bill 4659 (as reported without amendment)
Sponsor: Representative Joseph N. Bellino, Jr.
House Committee: Health Policy
Senate Committee: Health Policy and Human Services
CONTENT
The bill would amend the Public Health Code to prescribe certain exceptions to a requirement that prescriptions be transmitted electronically.
Beginning October 1, 2021, Section 17754a of the Code requires a prescriber or his or her agent to electronically transmit a prescription, including a prescription for a controlled substance, directly to a pharmacy of the patient's choice.
The requirement to transmit a prescription electronically does not apply under certain specified circumstances. Under the bill, the requirement also would not apply to the following circumstances:
-- If the prescription were dispensed by a dispensing prescriber.
-- If the prescription were for a dialysis-related drug that was administered as part of or incident to a home-based dialysis treatment.
