A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 479d.
the people of the state of michigan enact:
Sec. 479d. (1) A person who commits or attempts to commit a violent felony in which the victim is targeted because he or she is, or is perceived to be, a law enforcement officer, reserve officer, or corrections officer is guilty of a felony punishable by imprisonment for not more than 2 years, to be served consecutively to any term of imprisonment imposed for the underlying felony or attempted felony.
(2) As used in this section:
(a) "Corrections officer" means that term as defined in section 316.
(b) "Law enforcement officer" means that term as defined in section 2 of the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28.602.
(c) "Reserve officer" means an individual authorized on a voluntary or irregular basis by a duly authorized law enforcement agency of this state or a political subdivision of this state to act as a law enforcement officer, who is responsible for the preservation of the peace, the prevention and detection of crime, and the enforcement of the general criminal laws of this state.
(d) "Violent felony" means an offense against a person in violation of section 82, 83, 84, 85, 86, 87, 88, 89, 316, 317, 321, 349, 349a, 350, 397, 520b, 520c, 520d, 520e, 520g, 529, 529a, or 530 of the Michigan penal code, 1931 PA 328, MCL 750.82, 750.83, 750.84, 750.85, 750.86, 750.87, 750.88, 750.89, 750.316, 750.317, 750.321, 750.349, 750.349a, 750.350, 750.397, 750.520b, 750.520c, 750.520d, 750.520e, 750.520g, 750.529, 750.529a, and 750.530.
Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
Enacting section 2. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No.____ (request no. 02018'19) of the 100th Legislature is enacted into law.
