CONTENT
The bill would amend the Enhanced Driver License and Enhanced Official State Personal Identification Card Act to do the following:
-- Specify that an enhanced driver license or enhanced official State personal identification (ID) card that expired between February 1, 2020, and May 31, 2020, would be considered valid until June 30, 2020.
-- Require the SOS to process an application as a renewal of an existing driver license or ID card that expired between the dates specified above, if the Secretary of State (SOS) received it before June 30, 2020.
-- Prohibit the SOS from assessing a late renewal fee for an enhanced driver license or enhanced ID card that expired between the dates above and was renewed before June 30, 2020.
The Act allows the Secretary of State to issue an enhanced driver's license or enhanced ID card to an applicant who provides satisfactory proof of certain personal information. The Act specifies that its requirements are in addition to the requirements otherwise imposed on individuals who apply for a standard driver license or standard official State personal ID card.
Generally, an enhanced license or ID card expire on the birthday of the individual to whom the license or ID card is issued in the fourth year following the date of the issuance of the licensure or on the date the individual is no longer considered legally present in the United States, whichever is earlier. Under the bill, an enhanced driver license or enhanced ID card that expired between February 1, 2020, and May 31, 2020, would be considered valid until June 30, 2020.
The Act also establishes a schedule of fees to be deposited into the Enhanced Driver License and Enhanced Official State Personal Identification Card Fund created under the Act. An application for an original enhanced driver license or ID card must be accompanied by a fee of $50. In addition, the renewal fee for an enhanced driver license or ID card may not exceed $50. However, if an enhanced driver license or ID card was expired at the time of renewal, the fee must be the same as an original enhanced driver license or enhanced ID card.
Under the bill, if the SOS received an application before June 30, 2020, to renew an enhanced driver license or enhanced ID card that expired between February 1, 2020, and May 31, 2020, the SOS would have to process the application as a renewal of an existing enhanced driver license or enhanced ID card.
FISCAL IMPACT
The bill would not have a significant fiscal impact on the Department of State, as the fees from renewals of enhanced driver licenses or enhanced official State identification cards eventually will be collected by the Department, albeit at a later date than normal.
Regarding late fees, the Department could see a decrease in revenue as the Department of State would not assess a late fee at renewal for a license or registration that expired between February 1, 2020, and May 31, 2020, so long as renewal occurred by June 30, 2020 (as stated in Executive Order 2020-47). On average, the Department of State collects an estimated $965,000 per month in late fees, a portion of which come from late fees for renewals of an enhanced driver license or an enhanced official State identification card.
