A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 411x.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 411x. (1) A person who sets a contraption or device that
is intentionally made or set in a manner that renders the
contraption or device capable of causing injury or death to an
individual and who leaves, or permits that contraption or device to
be left, in or about any place that other individuals may come into
contact with that device is guilty of a felony punishable by
imprisonment for not more than 2 years or a fine of not more than
$1,000.00, or both.
(2) A person who violates subsection (1) and by that violation
causes the injury of another individual is guilty of a felony
punishable by imprisonment for not more than 5 years or a fine of
not more than $5,000.00, or both.
(3) A person who violates subsection (1) and by that violation
causes the serious impairment of a body function of another
individual is guilty of a felony punishable by imprisonment for not
more than 10 years or a fine of not more than $7,500.00, or both.
As used in this subsection, "serious impairment of a body function"
means that term as defined in section 58c of the Michigan vehicle
code, 1949 PA 300, MCL 257.58c.
(4) A person who violates subsection (1) and by that violation
causes the death of another individual is guilty of a felony
punishable by imprisonment for not more than 15 years or a fine of
not more than $10,000.00, or both.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
