     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding sections 20210 and 20210a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 20210. (1) The department shall establish and maintain a

 

database of health facilities or agencies as a central

 

clearinghouse for persons seeking information on health facilities

 

or agencies. Subject to subsection (2), the database shall include,

 

at a minimum, all of the following:

 

     (a) The name, address, and telephone number of each health

 

facility or agency.

 

     (b) The days and general hours of operation of each health

 

facility or agency.

 

     (c) The license number, license effective date, and license

 

expiration date of each health facility or agency.

 


     (d) A list of each health facility's or agency's violations of

 

this article or the rules promulgated under this article.

 

     (e) The number and nature of disciplinary actions taken by the

 

department against each health facility or agency under this

 

article.

 

     (f) The number, nature, and results of complaint

 

investigations regarding each health facility or agency conducted

 

by the department.

 

     (g) The number, nature, and results of abuse, neglect, and

 

exploitation investigations conducted under sections 11 to 11e of

 

the social welfare act, 1939 PA 280, MCL 400.11 to 400.11e, that

 

involve a patient or resident of a health facility or agency.

 

     (h) Based on the information provided to the department by

 

municipalities under section 20210a, a list of each health

 

facility's or agency's violations of municipal ordinances that

 

involve health or safety.

 

     (2) The department shall not include in the database

 

established under subsection (1) any information that is prohibited

 

from being disclosed under the laws of this state or federal law.

 

     (3) The department shall make the database established under

 

subsection (1) available to the public on the internet, without

 

charge, through the department's website.

 

     (4) The department shall inform the public, through press

 

releases or other media avenues, of the information available in

 

the database established under subsection (1) and how to access

 

that database.

 

     Sec. 20210a. (1) A municipality shall notify the department if


a health facility or agency violates an ordinance of the

 

municipality that involves health or safety. The department shall

 

use the information obtained in this section for the purpose of

 

updating the database established in section 20210.

 

     (2) As used in this section, "municipality" means a county,

 

city, village, or township.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
