SUBSTITUTE FOR

 

HOUSE BILL NO. 5889

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

by amending section 30711 (MCL 324.30711), as added by 1995 PA 59.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 30711. (1) The county board may determine by resolution

 

that the whole or a part of the cost of a project to establish and

 

maintain a normal level for an inland lake shall be defrayed by

 

special assessments against all of the following that are benefited

 

by the project: privately

 

     (a) Privately owned parcels of land. , political

 

     (b) Political subdivisions of the this state. , and state

 

     (c) State-owned lands under the jurisdiction and control of

 

the department.

 

     (2) If the county board determines that a special assessment

 


district is to be established, the delegated authority shall

 

compute the cost of the project and prepare a special assessment

 

roll.

 

     (3) If any of the lands subject to a special assessment

 

described in subsection (1) are lands described in section 2150 and

 

money is appropriated for purposes of paying the special

 

assessments, the department shall pay the county board for the

 

special assessments with the appropriated money.

 

     (4) (2) If the revenues raised pursuant to by the special

 

assessment are insufficient to meet the computation of cost

 

included in section 30712, or if these revenues are insufficient to

 

meet bond obligations, the special assessment district may be

 

reassessed without hearing using the same apportioned percentage

 

used for the original assessment.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
