SENATE BILL No. 344

     A bill to amend 1998 PA 58, entitled

 

"Michigan liquor control code of 1998,"

 

by amending section 533 (MCL 436.1533), as amended by 1998 PA 416.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 533. (1) A An applicant for a license to sell for

 

consumption on the premises or a retail vendor licensed under this

 

act to sell for consumption on the premises may apply for a license

 

as a specially designated merchant.

 

     (2) A An applicant for a specially designated distributor

 

merchant license or a retail vendor licensed under this act as a

 

specially designated merchant may apply for a license as a

 

specially designated merchant.distributor.

 

     (3) In cities, incorporated villages, or townships, the

 

commission shall issue only 1 specially designated distributor


license for each 3,000 of population, or fraction of 3,000. The

 

commission may waive the quota requirement may be waived at the

 

discretion of the commission if there is no existing specially

 

designated distributor licensee within 2 miles of the applicant,

 

measured along the nearest traffic route.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 345                                      

 

          of the 98th Legislature is enacted into law.
