     A bill to amend 1939 PA 280, entitled

 

"The social welfare act,"

 

(MCL 400.1 to 400.119b) by adding section 107a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 107a. (1) For a medical assistance application for a

 

patient of a nursing home, if the department of community health

 

has not completed the eligibility assessment and mailed the

 

applicant a notice of approval or denial within 45 days from the

 

date the local office received the medical assistance application

 

and, if necessary, a signed assets declaration, the applicant shall

 

be considered approved for medical assistance. If, after an

 

applicant has been automatically approved for medical assistance

 

under this section and upon completion of the department of

 

community health's eligibility assessment, the department of

 

community health determines that the applicant is ineligible for


 

medical assistance, the applicant shall no longer receive medical

 

assistance.

 

     (2) If a federal waiver or amendment to the state plan is

 

required to implement the provisions of this section, the

 

department of community health shall apply immediately upon

 

enactment of the amendatory act that added this section for that

 

federal waiver or amendment to the state plan.
