by amending sections 13, 17, 21, 25, 27, 29, 31, 37, 38, and 43
(MCL 338.2213, 338.2217, 338.2221, 338.2225, 338.2227, 338.2229,
338.2231, 338.2237, 338.2238, and 338.2243), sections 13, 17, 21,
25, 27, 29, 31, 37, and 38 as amended by 2012 PA 308 and section
43 as amended by 2013 PA 78.

21 (2) A fee is not required for the registration of property
22 approved under the land sales act, 1972 PA 286, MCL 565.801 to
23 565.835.
24 (3) The real estate education fund is created in the state
25 treasury. All of the following apply to the real estate education
26 fund:
27 (a) Fifteen dollars of each license fee received by the
28 department under subsection (1)(b) during that 3-year license
1 cycle shall be forwarded to the state treasurer for deposit into
2 the real estate education fund.
3 (b) The department shall use the money in the real estate
4 education fund only for the operation of departmental programs
5 related to education required of all licensees or applicants for
6 licensure under article 25 of the occupational code, MCL 339.2501
7 to 339.2518.
8 (c) The state treasurer shall direct the investment of the
9 fund and shall credit to the fund interest and earnings from fund
10 investments.
11 (d) Money in the fund at the close of the fiscal year shall
12 remain in the fund and shall not lapse to the general fund.
13 (e) The department is the administrator of the fund for
14 auditing purposes.
15 (4) The real estate enforcement fund is created in the state
16 treasury. All of the following apply to the real estate
17 enforcement fund:
18 (a) Fifteen dollars of each license fee received by the
19 department under subsection (1)(b) during that 3-year license
20 cycle shall be forwarded to the state treasurer for deposit into
21 the real estate enforcement fund.
22 (b) The department in conjunction with the attorney general
23 shall use the money in the real estate enforcement fund only for
24 the investigation and enforcement of actions regarding unlicensed
25 activity and real estate fraud.
26 (c) The state treasurer shall direct the investment of the
27 fund and shall credit to the fund interest and earnings from fund
1 investments.
2 (d) Money in the fund at the close of the fiscal year shall
3 remain in the fund and shall not lapse to the general fund.
4 (e) The department is the administrator of the fund for
5 auditing purposes.
6 Sec. 38. (1) Fees for an individual licensed or seeking
7 licensure as a state licensed real estate appraiser, a certified
8 general real estate appraiser, a certified residential real
9 estate appraiser, or a limited real estate appraiser under
10 article 26 of the occupational code, MCL 339.2601 to 339.2637,

19 (2) The license fee includes a fee imposed by the federal
20 government under 12 USC 3338 for certified general real estate
21 appraisers, certified residential real estate appraisers, and
22 state licensed real estate appraisers. The amount of the fee
23 described in this subsection shall not exceed $50.00 per
24 licensee, and the department shall collect and pay the fee to the
25 federal government under section 2637 of the occupational code,
26 MCL 339.2637.
27 (3) The real estate appraiser education fund is created in
28 the state treasury. All of the following apply to the real estate
29 appraiser education fund:
1 (a) Ten dollars of each fee received under subsection (1)(c)
2 shall be forwarded to the state treasurer for deposit into the
3 real estate appraiser education fund.
4 (b) The department shall use the money in the real estate
5 appraiser education fund only for the operation of departmental
6 programs related to the education required of all licensees or
7 applicants for licensure under article 26 of the occupational
8 code, MCL 339.2601 to 339.2637.

27 Enacting section 1. This amendatory act takes effect October
28 1, 2015.
