CONTENT
The bill would amend the fingerprinting law, Public Act 120 of 1935, to maintain current fee amounts for taking and processing fingerprints and processing named-based criminal history checks (ICHAT) charged by the Michigan Department of State Police (MSP), by delaying the expiration of these fees from September 30, 2015, to September 30, 2019. The current fingerprint processing fee is $30 and the name-based criminal history check fee is $10.
The bill also would eliminate a requirement that the MSP annually submit a report to the Legislature stating whether the fingerprinting fee is sufficient to cover actual MSP costs of performing the processing and what those actual costs are.
The bill would take effect October 1, 2015.
FISCAL IMPACT
The bill would have a significant positive impact on the FY 2015-16 budget for the MSP. Built into the MSP budget as recommended by the Governor, Senate, and House is $13.6 million from the fees addressed in the bill ($6.4 million from fingerprint fees and $7.2 million in name check fees), which would provide the funding for these processing services within MSP's Criminal Justice Information Center.
