Senate Bill 338 (as introduced 5-19-15)

Sponsor:  Senator John Proos

Committee:  Health Policy

Date Completed:  10-6-15

CONTENT

The bill would amend the Public Health Code to require a home for the aged or nursing home where on-premises medical or dental care was provided to residents or patients to have a private examination room for the purpose of medical or dental examination and treatment.

The room would have to be used exclusively for the examination and treatment of residents or patients, and would have to be kept separate from common areas, dining facilities, patient rooms, and restrooms. The room would have to have a door or other means of preventing the entry of unauthorized individuals.

The Department of Licensing and Regulatory Affairs could promulgate rules or adopt guidelines for the required examination rooms.

FISCAL IMPACT

The bill would have a minor, but negative fiscal impact on the Department of Licensing and Regulatory Affairs, and no fiscal impact on local units of government. The proposed changes themselves would have little impact on the cost to regulate and inspect nursing homes, but the bill would allow for changes in administrative rules associated with those regulations. Any changes made to administrative rules would result in some minor costs to the Department.
