A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1280g.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1280g. (1) The department shall do all of the following
to help ensure that more pupils will achieve a score of at least
proficient in reading on the grade 3 state assessment:
(a) Not later than April 1, 2014, develop and submit to the
senate and house standing committees on education a report
identifying programs that have been demonstrated to be successful
in helping low-performing elementary grade students to become more
proficient in reading.
(b) Not later than June 1, 2014, recommend or develop 1 or
more reading programs for improving the reading skills of pupils to
a level that will allow them to become proficient in reading by the
end of grade 3, as measured by the grade 3 state assessment. The
program or programs shall focus on diagnostic evaluation, early
intervention, tutoring, and mentoring.
(c) For the 2014-2015 school year, implement the program or
programs recommended or developed under subdivision (b) as a pilot
program for a combined total of up to 400 pupils in grades K-3 in
up to 4 school districts or public school academies, at least 1 of
which is located in an urban area.
(d) Develop a process to allow pupils to retake the grade 3
reading assessment as allowed under section 1280f.
(2) Beginning in the 2014-2015 school year, the board of a
school district or board of directors of a public school academy
shall do all of the following to help ensure that more pupils will
achieve a score of at least proficient in reading on the grade 3
state assessment:
(a) Use effective early screening instruments to identify
early literacy delays for all pupils in grades K to 2 and for grade
3 pupils who have previously been identified as experiencing early
literacy delays. This early screening shall be conducted within the
first 30 school days of each school year.
(b) If a pupil is identified as having an early literacy
delay, notify the pupil's parent or legal guardian of the delay in
writing and provide tools to assist the parent or legal guardian to
engage in intervention at home.
(c) Use intensive intervention programs to provide
intervention for any pupil identified as experiencing an early
literacy delay. The school district or public school academy may
choose the intensive intervention program or programs that it will
use to comply with this subdivision. If a school district or public
school academy uses a summer school program as the intensive
intervention for a pupil who is identified as having an early
literacy delay in grade 3, the pupil is still subject to section
1280f and the school district or public school academy shall ensure
that the pupil is given the opportunity to retake the grade 3
reading assessment before enrolling in grade 4, as allowed under
section 1280f.
(d) Submit early literacy data to the department annually in
the form and manner prescribed by the department.
(3) The department shall seek funding for the pilot program or
programs under subsection (1) from private and public sources. The
legislature shall appropriate funds from these sources, and from
the state school aid fund as necessary, for the 2014-2015 state
fiscal year for the pilot program or programs.
Enacting section 1. This amendatory act does not take effect
unless House Bill No. 5111 of the 97th Legislature is enacted into
law.
