A bill to amend 1967 (Ex Sess) PA 7, entitled
"Urban cooperation act of 1967,"
by amending sections 4 and 5b (MCL 124.504 and 124.505b), section 4
as amended by 2002 PA 439 and section 5b as added by 1998 PA 169.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
4. (1) A Subject
to subsection (2), a public agency of
this state may exercise jointly with any other public agency of
this state, with a public agency of any other state of the United
States, with a public agency of Canada, or with any public agency
of the United States government any power, privilege, or authority
that the agencies share in common and that each might exercise
separately.
(2) Beginning on the effective date of the amendatory act that
added this subsection, an interlocal agreement entered into under
this section and section 5 may be terminated or rescinded by a
referendum of the residents of the geographic area served by a
public agency that is a party to the interlocal agreement as
provided in subsection (3).
(3) If within 45 days after an interlocal agreement is entered
into by a public agency a petition is signed by a minimum of 8% of
the registered electors of the geographic area served by that
public agency voting in the last general election before the public
agency entered into the interlocal agreement, a referendum shall be
held in the geographic area served by that public agency at the
next regularly scheduled election or at a special election held for
this purpose. If a majority of the electors of the geographic area
served by that public agency voting on the interlocal agreement
approve the interlocal agreement, the public agency may enter into
the interlocal agreement. If a petition is not filed as provided in
this section, the public agency may enter into the interlocal
agreement.
Sec. 5b. A petition under section 4, 5a, or 8a, including the
circulation and signing of the petition, is subject to section 488
of the Michigan election law, 1954 PA 116, MCL 168.488. A person
who violates a provision of the Michigan election law, 1954 PA 116,
MCL 168.1 to 168.992, applicable to a petition described in this
section is subject to the penalties prescribed for that violation
in the Michigan election law, 1954 PA 116, MCL 168.1 to 168.992.
