A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending sections 506, 527, and 560 (MCL 380.506, 380.527, and
380.560), section 506 as added by 1993 PA 362, section 527 as added
by 2003 PA 179, and section 560 as added by 2009 PA 205.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 506. (1) A public school academy, with the approval of
the authorizing body, may employ or contract with personnel as
necessary for the operation of the public school academy, prescribe
their duties, and fix their compensation.
(2) In employing or contracting for personnel, a public school
academy shall comply with, and shall ensure that a contractor
complies with, all of the following:
(a) Shall ensure that at least 25% of the individuals employed
by or at the public school academy reside within 50 miles of the
public school academy.
(b) Shall submit all employment opportunities by or at the
public school academy to the department for posting on the
department's website.
(c) Shall inform the department whenever an employment
opportunity by or at the public school academy is filled, including
whether or not it was filled with an individual who resides within
50 miles of the public school academy.
(3) The department shall post job opportunities received under
subsection (2)(b) on the department's website and shall monitor the
information received under subsection (2)(c) to ensure that a
public school academy is complying with subsection (2)(a).
Sec. 527. (1) An urban high school academy, with the approval
of the authorizing body, may employ or contract with personnel, or
enter into a contract with another party to furnish teachers or
other personnel, as necessary for the operation of the urban high
school academy, prescribe their duties, and fix their compensation.
(2) In employing or contracting for personnel, an urban high
school academy shall comply with, and shall ensure that a
contractor complies with, all of the following:
(a) Shall ensure that at least 25% of the individuals employed
by or at the urban high school academy reside within 50 miles of
the urban high school academy.
(b) Shall submit all employment opportunities by or at the
urban high school academy to the department for posting on the
department's website.
(c) Shall inform the department whenever an employment
opportunity by or at the urban high school academy is filled,
including whether or not it was filled with an individual who
resides within 50 miles of the urban high school academy.
(3) The department shall post job opportunities received under
subsection (2)(b) on the department's website and shall monitor the
information received under subsection (2)(c) to ensure that an
urban high school academy is complying with subsection (2)(a).
Sec. 560. (1) A school of excellence, with the approval of the
authorizing body, may employ or contract with personnel as
necessary for the operation of the school of excellence, prescribe
their duties, and fix their compensation. A school of excellence
may implement and maintain a method of compensation for its
employees that is based on job performance, job accomplishments,
and job assignment in a subject area or school that is difficult to
find employees to staff.
(2) In employing or contracting for personnel, a school of
excellence shall comply with, and shall ensure that a contractor
complies with, all of the following:
(a) Shall ensure that at least 25% of the individuals employed
by or at the school of excellence reside within 50 miles of the
school of excellence.
(b) Shall submit all employment opportunities by or at the
school of excellence to the department for posting on the
department's website.
(c) Shall inform the department whenever an employment
opportunity by or at the school of excellence is filled, including
whether or not it was filled with an individual who resides within
50 miles of the school of excellence.
(3) The department shall post job opportunities received under
subsection (2)(b) on the department's website and shall monitor the
information received under subsection (2)(c) to ensure that a
school of excellence is complying with subsection (2)(a).
