A bill to amend 2010 PA 275, entitled
"Next Michigan development act,"
(MCL 125.2951 to 125.2959) by adding section 4a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 4a. (1) Beginning on the effective date of the amendatory
act that added this section, if a local governmental unit approves
a resolution to become a member of or to extend the duration of an
existing agreement with an eligible act 7 entity, that approval is
subject to a referendum as provided in this section.
(2) Upon petition by not less than 10% of the registered
electors residing in the local governmental unit collected within
90 days immediately following the approval of the resolution,
requesting a referendum on the question of becoming a member of or
extending the duration of an existing agreement with an eligible
act 7 entity, the clerk of the local governmental unit, upon
verifying the required number of signatures on the petitions, shall
file a copy of the petition with the county clerk and submit the
question of whether the local governmental unit should become a
member of or extend the duration of an existing agreement with the
eligible act 7 entity at the next general election or special
election called for that purpose and conducted in accordance with
the Michigan election law, 1954 PA 116, MCL 168.1 to 168.992.
(3) If approved by a majority of the electors in the local
governmental unit voting on the question, the local governmental
unit shall proceed to become a member of or extend the duration of
an existing agreement with the eligible act 7 entity in the manner
provided under this act.
