CONTENT
The bill would amend Public Act 120 of 1935 by extending the October 1, 2012, sunset date to October 1, 2015, for the collection of fingerprint and named-based criminal background check fees.
FISCAL IMPACT
The bill would allow for the continuance of fee collection by Department of State Police for fingerprint and name criminal background checks for FY 2012-13 and through FY 2014-15. The revenue from these fees, used to support the costs of the State's criminal history information system, is expected to total $15.0 million for FY 2012-13, should they be allowed to continue. From that total, $6.0 million would come from an existing $10 fee charged for access to the Internet Criminal History Access Tool (ICHAT) for criminal history name checks sought by those other than government or nonprofit agencies. The remaining $9.0 million in revenue would come from an existing fee of $30 for processing a fingerprint criminal history background check, largely requested for employment or licensing-related purposes. These funds are reflected in FY 2012-13 appropriations for the Department and, if the sunset is not delayed, program support will be reduced.
