CMV DRIVER: HOURS OF OPERATION S.B. 1154:
COMMITTEE SUMMARY
Senate Bill 1154 (as introduced 5-31-12)
CONTENT
The bill would amend the Motor Carrier Safety Act to provide that the Act would not restrict the number of consecutive hours of operation that a motor carrier operating entirely in intrastate commerce solely in Michigan may permit or require of the operator of a commercial motor vehicle (CMV) engaged in seasonal construction-related activities.
Currently, a motor carrier operating entirely in intrastate commerce solely within Michigan may not permit or require a CMV operator engaged in seasonal construction-related activities to do either of the following:
-- Operate for any period after having been on duty 80 hours in any period of eight consecutive days.
-- Operate more than 12 hours or be on duty more than 16 hours in any day.
The bill would eliminate these restrictions.

FISCAL IMPACT
The bill would have a negligible fiscal impact on State government as the elimination of restrictions could result in a marginal decrease in State civil infraction fine revenue.
