CONTENT
The bill would amend Public Act 120 of 1935 by delaying for two years the sunset dates for the collection by the Department of State Police of a $30 fee for taking and processing fingerprints and completing a criminal record check for employment and license-related purposes, and a $10 fee for processing a name-based criminal record check when requested by someone other than a government agency or nonprofit charitable agency performing employment name-based background checks through the Internet Criminal History Access Tool (ICHAT). The bill would change the sunset dates from October 1, 2010, to October 1, 2012.


The bill's provisions would take effect October 1, 2010.

FISCAL IMPACT

The bill would allow the continued administration and collection of the two fees beyond their current sunset date of October 1, 2010, and until October 1, 2012. The Department received an average of approximately $6.5 million from the fingerprint processing fee and $3.9 million from the ICHAT fee over each of the last two years. The fees are used by the Department of State Police to support the administration of these criminal history background checks and associated record-keeping and reporting system functions.
