A bill to amend 1994 PA 451, entitled “Natural resources and environmental protection act,” by amending sections 8501, 8517, and 8520 (MCL 324.8501, 324.8517, and 324.8520), section 8501 as amended by 2008 PA 13, section 8517 as amended by 2008 PA 14, and section 8520 as added by 2006 PA 503, and by adding sections 8512b and 8512f.

Reps. Calley and Meekhof, having reserved the right to explain their protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

I voted against House Bill 5368 because an outright ban unnecessarily ties the hands of the agriculture industry and residential users.

A $500 fine on an individual who may inadvertently use phosphorous also is excessive. There are some circumstances when phosphorous is a necessary application. The bill makes it more difficult for an individual who needs to apply a higher level of phosphorous in order to maintain a healthy lawn to do so absent government regulations.

Due to these reasons, I cannot vote in favor of this legislation as it is currently written.”

Reps. Elsenheimer and Knollenberg, having reserved the right to explain their protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

I voted against House Bill 5368 because an outright ban unnecessarily ties the hands of the agriculture industry and residential users.

A $500 fine on an individual who may inadvertently use phosphorous also is excessive. There are some circumstances when phosphorous is a necessary application. “Sec. 6. A sign owner shall apply for an annual permit on a form prescribed by the department for each sign to be maintained or to be erected in an adjacent area where the facing of the sign is visible from an interstate highway, freeway, or primary highway. A sign owner shall apply for a separate sign permit for each sign for each highway subject to this act from which the facing of the sign is visible. The owner shall apply for the permit for such signs which become subject to the permit requirements of this act because of a change in highway designation or other reason not within the control of the sign owner within 2 months after the sign becomes subject to the permit requirements of this act. The form shall require the name and business address of the applicant, the name and address of the owner of the property on which the sign is to be located, the date the sign, if currently maintained, was erected, the zoning classification of the property, a precise description of where the sign is or will be situated and a certification that the sign is not prohibited by section 18(a), (b), (c), or (d) and that the sign does not violate any provisions of this act. A SIGN OWNER IN POSSESSION OF A VALID PERMIT SUBJECT TO SECTION 18(F) IS NOT IN VIOLATION OF ANY OF THE PROVISIONS OF THIS ACT IF THE PERMIT SUBJECT TO SECTION 18(F) WAS IN COMPLIANCE WITH THIS ACT ON THE DAY BEFORE THE EFFECTIVE DATE OF THE AMENDATORY ACT THAT ADDED SUBSECTION (13) TO SECTION 7A. The sign permit application shall include a statement signed by the owner of the land on which the sign is to be placed, acknowledging that no trees or shrubs in the adjacent highway right-of-way may be removed, trimmed, or in any way damaged or destroyed without the written authorization of the department. The department may require documentation to verify the zoning, the consent of the land owner, and any other matter considered essential to the evaluation of the compliance with this act.”.

Whereas, The Family Day initiative has been proclaimed in Huron County, Michigan in an effort to promote positive parenting; and

Whereas, The use of illegal drugs and the abuse of alcohol and nicotine constitute the greatest threats to the well-being of America’s children; and

Whereas, Surveys conducted by the National Center on Addiction and Substance Abuse (CASA) at Columbia University have consistently found that the more often children and teenagers eat dinner with their families, the less likely they are to smoke, drink, and use illegal drugs; and

Whereas, Children who virtually never eat dinner with their families are 72 percent more likely than the average teenager to use illegal drugs, alcohol, and cigarettes; and

Whereas, The correlation between family dinners and reduced risk for teen substance abuse are well documented; and

Whereas, Parental influence is known to be one of the most crucial factors in determining the likelihood of substance abuse and underage drinking by children; and

Whereas, Parents are the first and most important role model in a child’s life; and

Whereas, Family dinners have long constituted a substantial pillar of family life in America, now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare Monday, September 27, 2010, as Family Day in the state of Michigan. We encourage all counties in the state of Michigan to educate Americans on the commitment and dedication to individuals, families, and communities everywhere that the Family Day initiative provides; and be it further

A resolution to urge the U.S. Coast Guard and the Michigan and U.S. Attorney General to take immediate and decisive action to identify and prosecute the perpetrators responsible for the illegal dumping leading to trash and medical waste washing up on Lake Michigan beaches.

Whereas, Once again, medical waste and other garbage has been washing up on Lake Michigan beaches. This waste creates a potentially dangerous situation to Michigan residents exposed to syringes, empty blood vials, and other waste. In addition, local communities and taxpayers are being forced to bear the cost of cleaning up the mess and the potential economic hit during the summer tourism season—a situation further straining local budgets; and

Whereas, The responsible party must be held accountable for trashing Michigan beaches this time. It is simply unacceptable that large amounts of garbage and medical waste can be dumped in the Great Lakes without consequences. Michigan taxpayers should not have to foot the bill again for the illegal actions of others; and

Whereas, The U.S. Coast Guard must make it a priority to identify the origins of this waste. Past experience clearly indicates that unless the responsible party is identified, this will not be an isolated incident and we can expect future incidents of medical waste and garbage washing up on Michigan beaches; now, therefore, be it

Resolved by the House of Representatives, That we urge the U.S. Coast Guard and the Michigan and U.S. Attorney General to take immediate and decisive action to identify and prosecute the perpetrators responsible for the illegal dumping leading to trash and medical waste washing up on Lake Michigan beaches; and be it further
