Rep. Robert Dean, from the 75th District, offered the following invocation:

“Almighty God, Father of all mankind, Lord of lords and King of kings, Thou who hast brought us to this eventful, long-expected day of destiny, we pause amid the roar of battle and the flood of words to bow in prayer, humble, sincere prayer, to Thee.

In this hour we find it extremely difficult to keep our thoughts on prayer and meditation. We are eager to hear the latest reports from yonder battlefields where the results of careful planning are being realized. We are attempting to be in Iraq, Afghanistan and America at the same time. Forgive us if we seem to be excited and a trifle unsteady this upcoming 4th of July, this history-making period, this moment when men are struggling, dying, but plunging bravely forward while life remains.

O God, be with the armies of the United States as they press onward against the defenses of the enemy. May confusion reign in the hearts of those arrayed against us. After 9 years, may war-weary peoples press for the end of this war and for peace.

Christ of God, as Thou didst look upon the multitudes and had compassion upon them, look upon those in uniform, upon those at home who love them, with that same compassion. Stay with us. Abide with us. Sustain our country in this terrible night of conflict and bring us to the morning at last. In Christ Jesus’ name, Amen.”

The Speaker, on behalf of the entire membership of the House of Representatives, offered the following resolution:

House Resolution No. 310.

A resolution of tribute offered as a memorial for Marvin Leonel Esch, former member of the House of Representatives.

Whereas, With the passing of Marvin Leonel Esch, Michigan and our country have lost a gentleman of great unselfishness and service. To the family that was the center of his life and his many friends across this state, we extend our sincere condolences; and

Whereas, Like so many of his generation, Marvin Esch’s life was touched by World War II. A veteran who served in the Army, Marvin Esch had earlier served with the U.S. Maritime Service and was aboard a Liberty Ship when it struck a German mine in the Atlantic and he was forced into a lifeboat. This devotion to his country remained a hallmark of his entire life; and

Whereas, A graduate of the University of Michigan who earned bachelor’s, master’s and doctoral degrees there, Marvin Esch was fiercely loyal to the Maize and Blue his entire life. Prior to entering elective service, he taught at his alma mater and at Wayne State University. In 1964, his strong sense of public duty led to him to the Michigan House of Representatives, where he served during a legislature that implemented many of the provisions of the new Michigan Constitution. In 1966, he was elected to the first of his five terms in the United States House of Representatives; and

Whereas, Congressman Esch was at the center of many of the key issues at a volatile time in our nation’s history. He worked on the transition to a volunteer military and fought racial discrimination in our education system. Even after he left the House, he continued his contributions as an education advisor to Presidents Reagan and George H. W. Bush. He also devoted himself to civic and charitable initiatives. Clearly, Marvin Esch displayed a loyalty to service to his country and community that will long be felt; now, therefore, be it

Resolved by the House of Representatives, That we offer this expression of our highest tribute to honor the memory of Marvin Leonel Esch, a member of this legislative body from 1965 to 1966 and a member of the U.S. House of Representatives from 1967 to 1976; and be it further

Resolved, That copies of this resolution be transmitted to the Esch family as evidence of our lasting esteem for his memory.

Rep. McMillin, having reserved the right to explain his protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

I voted No because I do not like state and federal centralized databases with citizens’ very personal health and prescription information. This bill expands those able to access this database and will give greater opportunities for abuse of that personal information. If ‘doctor shopping’ is perceived to be a serious problem, then I believe other ways can be found to curtail it other than exposing all MI citizens to giving greater access to their very personal prescription and health information.”

Rep. Miller, having reserved the right to explain his protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

Glad to see the Michigan House can take time out of regularly scheduled business to do the bidding of corporate lobbyists. Oh wait, that is regular business in the Michigan House. This retroactively costs the state $5.5 million annually at a time when we are struggling to fund important priorities like education, health care, and transportation. This when the excise tax is already set to phase out. I cannot accept business as usual and the people of Michigan shouldn’t either.”

A bill to amend 1980 PA 299, entitled “Occupational code,” by amending sections 720, 725, 726, 727, 728, 729, and 734 (MCL 339.720, 339.725, 339.726, 339.727, 339.728, 339.729, and 339.734), sections 720, 728, and 734 as amended by 2008 PA 161, sections 725 and 729 as amended by 2007 PA 1, and sections 726 and 727 as added by 1997 PA 10.

Rep. Johnson moved to amend the bill as follows:

1. Amend page 9, line 10, by striking out all of section 726 and inserting:

“Sec. 726. (1) The department shall issue a certificate as a certified public accountant to an individual who meets both of the following requirements:

(a) Holds holds a valid and unrevoked certificate as a certified public accountant issued by or under the authority of another state or United States jurisdiction . and meets either of the following conditions:

(a) (b) Provides proof that the applicant’s original certificate as a certified public accountant was secured on the basis of requirements that the board determines are equivalent to the standards required for qualification in this state at the same time the applicant was issued his or her original certificate.

(b) Has had 4 years of experience of the type described in section 725(4) after having passed the examination upon which the applicant’s certificate was based, within 10 years immediately preceding the date of application.

(2) The department shall issue a certificate as a certified public accountant to an individual who meets both of the following requirements:

(a) Holds holds a valid and unrevoked certificate as a certified public accountant or an equivalent title issued by or under the authority of a jurisdiction outside the United States that the board determines to be equivalent to the requirements to obtain a certificate of certified public accountant in this state as described in section 725.

(b) Has passed an examination on topics specific to the practice of public accounting in the United States and approved by the board.”.

House Resolution No. 309.

A resolution to memorialize the United States Senate to take swift actions to enact an extension of unemployment benefits and payments to the states under the Federal Medicaid Assistance Percentages program.

Whereas, The United States Senate’s recent failure to provide an extension of unemployment benefits and payments to the states under the Federal Medicaid Assistance Percentages (FMAP) funding program has threatened working families across this country and placed states in a most difficult situation. This action, taken within days of most states ending the current fiscal year and as Michigan grapples with its own grave budget situation, could be a crippling blow to the fragile economic recovery. For the workers trying to cope with double digit unemployment and the collapse of housing values, the prospect of the end of unemployment benefits is dire; and

Whereas, Failure to extend FMAP could create an additional budget shortfall of $500 million in the state of Michigan. The loss of this money would also threaten prescription drug coverage, mental health services, payments to Medicaid providers, revenue sharing, and university funding; and

Whereas, With the number of people suffering from long-term unemployment in this country already at frightening levels, the determination in the United States Senate not to extend these programs is damaging in many ways. Not only are hundreds of thousands of workers in Michigan alone facing an untenable situation, the stimulating effects of people putting their unemployment benefits directly into the economy will also be lost; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the United States Senate to take swift actions to enact an extension of unemployment benefits and payments to the states under the Federal Medicaid Assistance Percentages program; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

The resolution was referred to the Committee on Labor.

A bill to amend 1941 PA 122, entitled “An act to establish the revenue collection duties of the department of treasury; to prescribe its powers and duties as the revenue collection agency of this state; to prescribe certain powers and duties of the state treasurer; to establish the collection duties of certain other state departments for money or accounts owed to this state; to regulate the importation, stamping, and disposition of certain tobacco products; to provide for the transfer of powers and duties now vested in certain other state boards, commissions, departments, and offices; to prescribe certain duties of and require certain reports from the department of treasury; to provide procedures for the payment, administration, audit, assessment, levy of interests or penalties on, and appeals of taxes and tax liability; to prescribe its powers and duties if an agreement to act as agent for a city to administer, collect, and enforce the city income tax act on behalf of a city is entered into with any city; to provide an appropriation; to abolish the state board of tax administration; to prescribe penalties and provide remedies; and to declare the effect of this act,” by amending section 28 (MCL 205.28), as amended by 2009 PA 124.

A bill to amend 1974 PA 198, entitled “An act to provide for the establishment of plant rehabilitation districts and industrial development districts in local governmental units; to provide for the exemption from certain taxes; to levy and collect a specific tax upon the owners of certain facilities; to impose and provide for the disposition of an administrative fee; to provide for the disposition of the tax; to provide for the obtaining and transferring of an exemption certificate and to prescribe the contents of those certificates; to prescribe the powers and duties of the state tax commission and certain officers of local governmental units; and to provide penalties,” by amending section 15 (MCL 207.565), as amended by 2008 PA 170.

A bill to amend 1947 PA 336, entitled “An act to prohibit strikes by certain public employees; to provide review from disciplinary action with respect thereto; to provide for the mediation of grievances and the holding of elections; to declare and protect the rights and privileges of public employees; and to prescribe means of enforcement and penalties for the violation of the provisions of this act,” (MCL 423.201 to 423.217) by adding section 7b.

The bill was read a first time by its title and referred to the Committee on Education.
