SUBSTITUTE FOR

 

HOUSE BILL NO. 4518

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1873 PA 5, entitled

 

"An act to provide for the recording of judgments in actions

affecting or relating to the title of real estate,"

 

by amending section 1 (MCL 565.401).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) That whenever any If a final judgment shall have

 

been is rendered in any suit or action at law , affecting or

 

relating that affects or relates to the title of real estate, by

 

any a court having with competent jurisdiction, thereof, a copy of

 

such the judgment, duly certified by the clerk of said the court ,

 

and under the seal thereof of the court, may be received and

 

recorded in the office of the register of deeds for the county

 

where such the real estate is situated. and when so When recorded,

 

it shall have the judgment has the same effect as evidence and

 

notice of title as the recording of deeds and other conveyances,


 

and such the register of deeds shall be is entitled, for the

 

recording of such the judgment, to the same fees as for the

 

recording of deeds.

 

     (2) Unless state or federal law, rule, regulation, or court

 

order or rule requires that all or more than 4 sequential digits of

 

the social security number appear in the judgment, a register of

 

deeds shall not receive a judgment for recording unless the first 5

 

digits of any social security number appearing in or on the

 

judgment are obscured or removed.
