CONTENT
The bill would amend the Public Health Code to prohibit a health facility or agency from employing, independently contracting with, or granting clinical privileges to an individual who regularly had direct access to or provided direct services to patients or residents in the facility or agency if he or she had been convicted of a moving violation causing death or serious impairment of a body function. The bill would apply to a health facility or agency that is a nursing home, county medical care facility, hospice, hospital that provides swing bed services, home for the aged, or home health agency.


The bill would take effect on October 31, 2010, and is tie-barred to Senate Bill 104. (Senate Bill 104 (S-3), as passed by the Senate, would amend the Michigan Vehicle Code to establish criminal penalties for moving violations that seriously injured or killed another person; and require the Secretary of State to revoke the offender's driver license, assess a driver responsibility fee, and record six points on the offender's license.)
