AIRBOAT REGULATION SUNSET S.B. 336: FLOOR ANALYSIS

CONTENT
The bill would amend the Natural Resources and Environmental Protection Act to eliminate the May 1, 2007, sunset on a section restricting the operation of airboats.


Section 80108a prohibits a person from operating an airboat within 450 feet of a residence between 11:00 p.m. and 6:00 a.m. at a speed exceeding that required to maintain forward movement.


The prohibition does not apply to the operation of an airboat under any of the following circumstances: in an emergency when necessary to protect public safety; in the event the airboat runs aground and needs to be freed; or for a governmental purpose, if the airboat is clearly marked and identified as being used for a governmental purpose.


Section 80108a was enacted by Public Act 547 of 2004, and is scheduled to be repealed on May 1, 2007. The bill would eliminate the repeal.
