SUBSTITUTE FOR

HOUSE BILL NO. 4100

                         As amended March 3, 2005

     A bill to amend 1846 RS 2, entitled

"Of the legislature,"

by amending section 4 (MCL 4.84); and to repeal acts and parts of

acts.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

     Sec. 4. The oath of office of any member or officer of the

senate or house of representatives  ,  may be administered by, and

taken and subscribed before,  the chancellor, any a justice of the

supreme court, [JUDGE OF THE COURT OF APPEALS,] a judge of the circuit

 court, a judge of the

district court, the lieutenant governor, the president pro tempore

of the senate,  or the speaker of the house of representatives, or

any officer required to organize meetings of the legislature under

1877 PA 67, MCL 4.41 to 4.46.

     Enacting section 1.  Section 6 of 1877 PA 67, MCL 4.46, is

repealed.
