Subsequent to the final adjournment of the Regular Session of the Legislature, the following messages from the Governor were received:

December 28, 2006

Today I have signed Enrolled Senate Bill 647, which will prohibit the public release of involuntary statements made by a law enforcement officer when the statements are made under threat of dismissal from employment or any other employment sanction. Senate Bill 647 articulates four exceptions to the general rule that would otherwise keep these statements confidential. Involuntary statements may be released when: (1) the officer provides written consent to the disclosure; (2) the statement is obtained by a prosecutor or the attorney general pursuant to a search warrant, subpoena, or court order; (3) the statement is used in the context of an administrative or legal hearing relating to the officer's employment status or to defend a criminal action; or (4) when the statement is used in a civil action against a law enforcement agency or law enforcement officer.

Senate Bill 647 is referred to as "Garrity legislation" because it is based on the United States Supreme Court decision in Garrity v New Jersey, 385 US 493; 87 SCt 616 (1967). In that case, the Supreme Court recognized that unlike other American citizens, law enforcement officers can be forced to give up their Fifth Amendment right not to incriminate themselves. Law enforcement officers can be required to make incriminating statements under the threat of losing their job. Referring to this practice as "the antithesis of free choice to speak out or remain silent," the Court concluded that the 14th Amendment of the United States Constitution must protect law enforcement officers and bar the use of compelled statements in subsequent criminal proceedings. Garrity, at 497.

With the enactment of Enrolled Senate Bill 647, the rule of law expressed in Garrity v New Jersey is now codified in Michigan law. This new law will bring clarity to an area of the law that has been heavily litigated. The Garrity legislation will provide law enforcement agencies with an effective management tool to use when conducting internal investigations. It will clearly define the rights and obligations of all parties involved in an internal investigation.

Senate Bill 647 should not be interpreted as condoning police misconduct. It does not. Under this legislation, representatives and legal counsel for law enforcement officers and law enforcement agencies will have complete access to compelled statements in the context of administrative proceedings, regardless of whether the officer consents to the disclosure. Nor should this legislation be viewed as authorizing law enforcement officers to "cover up" for one another. It will not. This bill will not prevent law enforcement from gathering information on others who are implicated by a law enforcement officer when making a Garrity statement. Furthermore, the legislation will not curtail the public's ability to use Michigan's Freedom of Information Act to obtain access to law enforcement internal investigation records, once an investigation is completed. In sum, this legislation is not intended to create barriers to information that the public is rightfully entitled to know.

For these reasons, I have signed Enrolled Senate Bill 647.

January 5, 2007

I have signed into law Enrolled Senate Bill 826 and 827, which will strengthen Michigan law to protect consumers from unscrupulous building contractors. I applaud legislative approval of these measures to enhance confidence in the competency of licensed residential builders in Michigan and assure sufficient punishment for contractors who take advantage of consumers by working without a license. These bills impose tougher and more meaningful penalties for unlicensed residential constructions and provide tools for regulators and law enforcement officials to more effectively do their job.

While I have approved Senate Bills 826 and 827, the bills unfortunately will not take effect as they are tie-barred to Enrolled Senate Bills 631 and 632, which I have not approved. In adopting the latter two bills, the Legislature failed to address significant concerns raised by the Department of Labor and Economic Growth and others. Among these concerns is insufficient and inconsistent funding for the aggressive pursuit of unlicensed activity that is needed. The bills also would mandate that every licensed builder buy a code book he or she may never use. Perhaps these problems could have been averted had the normal committee hearing process for this legislation not been circumvented.

Because the State of Michigan must do more to protect its citizens from unlicensed and unscrupulous contractors, I look forward to working with the new 94th Legislature to forge consensus on the issues addressed by these bills and enact legislation that effectively improves protection for Michigan consumers.
