"This prayer goes out to every heart and every home in the state of Michigan, especially to the servicemen and servicewomen from Michigan who are fighting in Afghanistan and Iraq. A special prayer goes to those who are victims of Katrina, those who have been displaced and dispossessed and in many respects are here in this state looking for help. I know that we are doing a great job with that. I want to ask your help with this as we pray today. Help me in reciting the 23rd Psalm, 'The Lords Prayer'. Our Father, who art in heaven, hallowed be Thy name. Thy Kingdom come, Thy will by done, on earth as it is in heaven. Give us this day our daily bread. And forgive us our trespasses, as we forgive those who trespass against us. And lead us not into temptation, but deliver us from evil. For Thine is the kingdom, the power and the glory, for ever and ever, Amen".

House Bill No. 4260, entitled

A bill to amend 1951 PA 90, entitled "An act to regulate the conducting of racing meets in the state of Michigan; to provide for the possession, control and disposition of funds held by licensees for the payment of outstanding winning tickets not claimed or demanded by the lawful owners of such funds; and to prescribe penalties for violations of the provisions of this act," by amending section 2 (MCL 431.252), as amended by 1998 PA 505.

"An act to revise, consolidate, and codify the laws relating to criminal procedure and to define the jurisdiction, powers, and duties of courts, judges, and other officers of the court under the provisions of this act; to provide laws relative to the rights of persons accused of criminal offenses and ordinance violations; to provide for the arrest of persons charged with or suspected of criminal offenses and ordinance violations; to provide for bail of persons arrested for or accused of criminal offenses and ordinance violations; to provide for the examination of persons accused of criminal offenses; to regulate the procedure relative to grand juries, indictments, informations, and proceedings before trial; to provide for trials of persons complained of or indicted for criminal offenses and ordinance violations and to provide for the procedure in those trials; to provide for judgments and sentences of persons convicted of criminal offenses and ordinance violations; to establish a sentencing commission and to prescribe its powers and duties; to provide for procedure relating to new trials and appeals in criminal and ordinance violation cases; to provide a uniform system of probation throughout this state and the appointment of probation officers; to prescribe the powers, duties, and compensation of probation officers; to provide penalties for the violation of the duties of probation officers; to provide for procedure governing proceedings to prevent crime and proceedings for the discovery of crime; to provide for fees of officers, witnesses, and others in criminal and ordinance violation cases; to set forth miscellaneous provisions as to criminal procedure in certain cases; to provide penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act,"

House Concurrent Resolution No. 21.

A concurrent resolution to express our support for keeping "under God" in the Pledge of Allegiance to the United States flag.

Whereas, Our nation is a diverse collection of people whose origins span the globe. Our nation is not one of blood, ethnicity, or race; but is one of shared ideals. America is based on the belief that freedom, democracy, and opportunity are indispensable to our well being and will build a better tomorrow for the next generation. Our Pledge of Allegiance to the United States flag is a vital component of forging unity from such a diverse citizenry; and

Whereas, A federal District Court judge has ruled that the Pledge of Allegiance is unconstitutional based on the longstanding use of the expression "under God" in the pledge. Arguing that these two words unlawfully impose a religious belief on the schoolchildren who recite this pledge daily is absurd. This ruling requires the assumption that a simple affirmation of faith is equivalent to establishing a state religion as our Constitution forbids. This ruling requires us to believe that using "under God" in our pledge has somehow created a theocracy in our republic when common sense and history show that our democracy has prospered since 1954, when "under God" was added to the Pledge of Allegiance. No, our pledge as written is an affirmation of our unity that must not be weakened; and

Whereas, It is our fervent hope that common sense and respect for our history and diversity will lead our federal courts to reverse this federal District Court ruling. The federal District Court is but the first rung in our federal court system, so there is ample opportunity for rational thought to be brought to bear on this issue. Nor are our courts the last word in this battle. Should the judicial branch fail us, the United States Congress has the authority to recover what might be lost due to the actions of a few in defiance of the heartfelt views of our citizens; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we express our support for keeping "under God" in the Pledge of Allegiance to the United States flag; and be it further

Resolved, That copies of this resolution be transmitted to the Justices of the United States Supreme Court, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

House Concurrent Resolution No. 22.

A concurrent resolution to express to the United States Congress the resolve of the people of Michigan to continue using the words "under God" in the Pledge of Allegiance to the United States flag.

Whereas, Only a year after the United States Supreme Court rejected a case for lack of standing which pressed for the removal of "under God" from the Pledge of Allegiance to the United States flag, another case is working its way through the federal courts. This time, Sacramento federal District Court Judge Lawrence Karlton ruled that the pledge as it stands violates the right of schoolchildren to be "free from the coercive requirement to affirm God"; and

Whereas, The Pledge of Allegiance to the United States flag is a unifying patriotic exercise that has served our nation well for more than half a century. After five decades of schoolchildren reciting "under God" as part of the Pledge of Allegiance, we can look back on an era of unprecedented and ever expanding freedoms of beliefs, practices, speech, and thought. Our diverse nation is strengthened in its unity by teaching each new generation about our liberties and values. We cannot discard this record of success and the sincere beliefs expressed in our Pledge of Allegiance if this narrowly based objection to "under God" manages to succeed before our highest federal court; and

Whereas, The District Court judge stated that he was bound by precedent from the United States Court of Appeals for the Ninth Circuit. Given that the appeal to this latest case will go to the same Court of Appeals circuit, it is likely that the United States Supreme Court will once again be faced with an issue that resonates deeply with patriotic citizens who value the Pledge of Allegiance as a teaching tool to foster unity and an appreciation for our freedoms; and

Whereas, Should the United States Supreme Court fail to uphold the Pledge of Allegiance as we have recited for half a century, we should refuse to be browbeaten into submitting to this dictate of a narrowly focused minority view. Should the federal courts fail to reverse this lower court ruling, it will be up to the United States Congress to address the pledge in order to restore it to its rightful place in our society. Until such action can be taken, it will be up to the states to uphold the Pledge of Allegiance with "under God" in our classrooms; now, therefore, be it

STATE OF ENERGY EMERGENCY

EXTENSION FOR TEMPORARY USE OF DYED DIESEL FUEL

WHEREAS, Section 1 of Article V of the Michigan Constitution of 1963 vests the executive power of the State of Michigan in the Governor;

WHEREAS, under Section 4 of 1982 PA 191, MCL 10.84, during a declared State of Energy Emergency the Governor may by executive order suspend a statute, an order, a rule of a state agency, or a specific provision of the statute, rule, or order if strict compliance with the statute, order, rule, or a specific provision of the statute, rule, or order will prevent, hinder, or delay necessary action in coping with the energy emergency;

WHEREAS, effective August 31, 2005, in response to shortages of clear diesel fuel caused by the effects of Hurricane Katrina, the federal Environmental Protection Agency is temporarily allowing regulated parties to supply motor vehicle diesel fuel having a sulfur content greater than 500 parts per million with visible evidence of red dye;

WHEREAS, in response to the effects of Hurricane Katrina on diesel fuel supplies on September 2, 2005, the federal Internal Revenue Service declared that it will not impose a penalty when dyed diesel fuel is sold for use or used on highways;

WHEREAS, Executive Order 2005-20 suspended certain provisions of Michigan law to allow the use of dyed diesel fuel on Michigan highways without penalty;

WHEREAS, the Internal Revenue Service has extended the penalty waiver through October 5, 2005;

WHEREAS, appropriate measures must be taken in Michigan to ensure that fuel supplies will remain sufficient and to assure the health, safety, and welfare of Michigan residents and visitors;

NOW, THEREFORE, I, JENNIFER M. GRANHOLM, Governor of the State of Michigan, pursuant to powers vested in the Governor by the Michigan Constitution of 1963 and Michigan law, order the following:

1. The suspension under Executive Order 2005-20 of provisions of the Motor Fuel Tax Act, 2000 PA 403, MCL 207.1001 to 207.1170, relating to dyed diesel fuel is extended through October 5, 2005.
