A bill to amend 2001 PA 267, entitled
"Manufacturing milk law of 2001,"
(MCL 288.561 to 288.740) by adding section 110a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 110a. (1) Beginning the effective date of the
2 amendatory act that added this subsection and notwithstanding the
3 license and permit fees imposed under section 110, the department
4 shall issue an initial or renewal license or permit for regulated
5 activities described in section 110 not later than 6 months after
6 the applicant files a completed application. If the application
7 is considered incomplete by the department, the department shall
8 notify the applicant in writing within 10 days after receipt of
9 the incomplete application, describing the deficiency and
10 requesting the additional information. The 6-month period is
11 tolled upon notification by the department of a deficiency until
1 the date the requested information is received by the
2 department.
3 (2) If the department fails to issue or deny a license or
4 permit within the time required by this section, the department
5 shall return the license or permit fee and shall reduce the
6 license or permit fee for the applicant's next renewal
7 application, if any, by 15%. The department shall not
8 discriminate against an applicant in the processing of the
9 application based upon the fact that the application fee was
10 refunded or discounted under this subsection.
11 (3) Beginning January 31, 2005, the director shall submit a
12 report by January 31 of each year to the standing committees and
13 appropriations subcommittees of the senate and house of
14 representatives concerned with agricultural and food issues. The
15 director shall include all of the following information in the
16 report concerning the preceding calendar year:
17 (a) The number of initial and renewal applications the
18 department received and completed within the 6-month time period
19 described in subsection (1).
20 (b) The number of applications requiring a request for
21 additional information.
22 (c) The average time for an applicant to respond to a request
23 for additional information.
24 (d) The number of applications rejected, categorized by
25 reason for rejection.
26 (e) The amount of money returned to licensees and permittees
27 under subsection (2).
1 (f) The number of applications not issued within the 6-month
2 period.
3 (g) The average processing time for initial and renewal
4 applications granted after the 6-month period.
