A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
by amending section 5855 (MCL 600.5855).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 5855. (1) If a person who is or may be liable for
2 any a claim fraudulently conceals the existence of
the claim or
3 the identity of any a
person who is liable for the claim from
4 the knowledge of the
person entitled to sue on the claim, the
5 an action on the claim may be commenced at any time within 2
6 years after the person who is entitled to bring the action
7 discovers, or should have discovered, the existence of the claim
8 or the identity of the person who is liable for the claim,
9 although the action would otherwise be barred by the period of
10 limitations.
11 (2) This section does not apply to a claim alleging medical
1 malpractice and cannot be used to extend a limitation on
2 commencing an action alleging medical malpractice.
3 Enacting section 1. This amendatory act does not take effect
4 unless Senate Bill No. 690
5 of the 92nd Legislature is enacted into law.
