                                                                                 A bill to amend 1984 PA 431, entitled                                             

                                                                                

    "The management and budget act,"                                            

                                                                                

    (MCL 18.1101 to 18.1594) by adding sections 258, 259, and 260.              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 258.  The department, upon receiving and reviewing a                   

                                                                                

2   memorandum under section 257, shall do all of the following:                

                                                                                

3       (a) Check with the department of history, arts, and libraries               

                                                                                

4   to determine if the property is on the historical register.                 

                                                                                

5       (b) Request an environmental assessment, wetland study, or                  

                                                                                

6   survey, if needed.                                                          

                                                                                

7       (c) Notify other state departments to determine if there is                 

                                                                                

8   an alternative state use for the property.                                  

                                                                                

9       (d) Contact local governmental units, public universities,                  

                                                                                

10  and community colleges to determine if any of those entities have           

                                                                                

11  an interest in purchasing the property.                                     

                                                                                


                                                                                

1       (e) Obtain an appraisal of the property to determine its fair               

                                                                                

2   market value.                                                               

                                                                                

3       Sec. 259.  (1) If the department recommends the sale of the                 

                                                                                

4   state owned property, the department shall advertise for                    

                                                                                

5   interested bidders and shall prepare a sealed bid package and               

                                                                                

6   send the package to respondents.  After receiving and evaluating            

                                                                                

7   the bids, the department shall submit its recommendation for                

                                                                                

8   approval of sale to the state administrative board.                         

                                                                                

9       (2) The state administrative board shall approve or reject                  

                                                                                

10  sale of the property.                                                       

                                                                                

11      Sec. 260.  If a parcel of surplus state property is approved                

                                                                                

12  for sale by the department and the state administrative board               

                                                                                

13  under section 259, the department shall submit documentation of             

                                                                                

14  the proposed sale to the attorney general for approval.  The                

                                                                                

15  attorney general shall prepare the quitclaim deed for the                   

                                                                                

16  proposed sale.  The department shall conduct the closing and                

                                                                                

17  shall provide that a copy of all recorded documents be delivered            

                                                                                

18  to the department.  The department shall deposit any revenue                

                                                                                

19  derived from the conveyance in the appropriate state fund or                

                                                                                

20  account and shall forward a copy of the recorded deed to the                

                                                                                

21  office of the great seal of the department of state.                        

                                                                                

22      Enacting section 1.  This amendatory act does not take                      

                                                                                

23  effect unless Senate Bill No. 515                                           

                                                                                

24                           of the 92nd Legislature is enacted into            

                                                                                

25  law.
