A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9948) by adding section 2955c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2955c. (1) An individual or a legal representative of
2 an individual shall not bring or maintain a civil action for
3 injury or death arising from the individual's conduct if the
4 conduct is the basis of the individual's conviction of or guilty
5 plea or plea of nolo contendere to a violent crime or an offense
6 under federal law or the law of another state that substantially
7 corresponds to a violent crime.
8 (2) As used in this section, "violent crime" means 1 or more
9 of the following offenses:
10 (a) An offense included in the definition of "violent felony"
11 under section 36 of the corrections code of 1953, 1953 PA 232,
1 MCL 791.236.
2 (b) An offense that is a violation of section 49(8), (9), or
3 (10), 72, 73, 81(3) or (4), 81a, 81c(2) or (3), 81d(2), (3), or
4 (4), 110, 110a, 111, 147b(1)(a), 234a, 234b, 234c, or 479 of the
5 Michigan penal code, 1931 PA 328, MCL 750.49, 750.72, 750.73,
6 750.81, 750.81a, 750.81c, 750.81d, 750.110, 750.110a, 750.111,
7 750.147b, 750.234a, 750.234b, 750.234c, and 750.479.
8 (c) Commission of an act of terrorism as defined by section
9 543b of the Michigan penal code, 1931 PA 328, MCL 750.543b, that
10 causes death.
