A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending sections 11514 and 11545 (MCL 324.11514 and
324.11545).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11514. (1) A person shall not knowingly dispose of,
2 and an owner or operator of a landfill shall not knowingly permit
3 the disposal of, medical
waste any of the following in a
4 landfill:
5 (a) Medical waste, unless that medical waste has been
6 decontaminated or is not required to be decontaminated but is
7 packaged in the manner required under part 138 of the public
8 health code, Act No.
368 of the Public Acts of 1978, being
9 sections 333.13801 to
333.13831 of the Michigan Compiled Laws
10 1978 PA 368, MCL 333.13801 to 333.13831.
1 (b) The following batteries:
2 (i) Alkaline manganese batteries, lead acid batteries,
3 mercuric oxide batteries, nickel cadmium batteries, or zinc
4 carbon batteries, as defined in section 17101.
5 (ii) Lithium batteries.
6 (iii) Silver oxide cell batteries.
7 (iv) Zinc-air batteries.
8 (c) Fluorescent lightbulbs.
9 (2) As used in this section:
10 (a) "Lithium batteries" means solid-state batteries with a
11 lithium anode, an iodine-polyvinyl pyridine cathode, and an
12 electrolyte consisting of a layer of lithium iodide.
13 (b) "Silver oxide cell batteries" means batteries with a
14 primary cell in which depolarization is accomplished by an oxide
15 of silver.
16 (c) "Zinc-air batteries" means batteries containing a
17 carbon-based gas diffusion electrode as the cathode, a zinc
18 anode, and an alkaline electrolyte.
19 Sec. 11545. (1)
Beginning June 21, 1993, The
owner or
20 operator of a municipal solid waste incinerator shall not
21 knowingly incinerate used
any of the following in a municipal
22 solid waste incinerator:
23 (a) The following batteries:
24 (i) Alkaline manganese batteries, lead acid batteries,
25 mercuric oxide batteries, nickel cadmium batteries, or zinc
26 carbon batteries, as defined in section 17101.
27 (ii) Lithium batteries, silver oxide batteries, and zinc-air
1 batteries as defined in section 11514.
2 (b) Fluorescent lightbulbs.
3 (c) Used oil.
4 (2) As used in
this section, "used oil" has the meaning
5 ascribed to this term
in part 167 means that term as it
is
6 defined in section 16701.
