A bill to amend 1966 PA 291, entitled
"Fire fighters training council act of 1966,"
by amending section 13 (MCL 29.373) and by adding sections 14a
and 14b; and to repeal acts and parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 13. (1) There is created in the state treasury a fire
2 fighters training fund.
from which the legislature shall
3 appropriate such sums
as are deemed necessary for the purposes of
4 this act but in no
case shall such
5 (2) The state treasurer may receive money or other assets
6 from any source for deposit into the fund, including money
7 distributed to the fund from the public safety training fund
8 under section 3(c)(ii) of the public safety training fund act.
9 The state treasurer shall direct the investment of the fund. The
10 state treasurer shall credit to the fund interest and earnings
1 from fund investments.
2 (3) Money in the fund at the close of the fiscal year shall
3 remain in the fund and shall not lapse to the general fund.
4 (4) Money in the fund shall be expended, upon appropriation,
5 as provided in section 14a. However, those appropriations be in
6 excess of shall not exceed 75% of the amounts paid into
the
7 fund.
8 Sec. 14a. (1) Money in the fire fighters training fund
9 shall be expended as follows:
10 (a) First the council shall be reimbursed for the
11 administrative expenses of administering this act.
12 (b) Five percent of the money remaining after the
13 disbursement under subdivision (a) shall be expended for the
14 purpose of funding joint in-service training of, and facilitating
15 the collaboration of, personnel in law enforcement, fire service,
16 public emergency medical service, criminal prosecution and
17 courts, and emergency first responders, to prevent and respond to
18 accidents, natural disasters, and homeland security incidents.
19 The portion of the fund that is subject to this subsection shall
20 be distributed as grants to eligible entities, as provided in
21 section 14b.
22 (c) One percent of the money remaining after the
23 disbursements under subdivisions (a) and (b) shall be expended
24 for the purpose of developing an automated system for tracking
25 the in-service training of fire fighters. The council shall
26 develop the automated system not later than 3 years after the
27 effective date of this section. The disbursement under this
1 subdivision no longer applies after the expiration of 3 years
2 after the effective date of this section.
3 (d) The balance of the money, after the disbursements under
4 subdivisions (a), (b), and (c), shall be distributed on a
5 reimbursement basis to local fire departments, both paid and
6 volunteer, for mandated in-service training conducted during the
7 previous year. The money shall be distributed to fire
8 departments based on the number of full-time equated fire
9 fighters trained by the council, employed and volunteer, at each
10 fire department. An amount not greater than 10% of the amount
11 distributed to a fire department may be expended for the purchase
12 of equipment directly related to in-service training.
13 (e) If any money remains in the fund after the disbursements
14 under subdivisions (a), (b), (c), and (d), that money shall
15 revert to the public safety training fund created in the public
16 safety training fund act for distribution in future years and
17 shall not revert to the general fund or be used for any other
18 purpose.
19 (2) The council shall promulgate rules pursuant to the
20 administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to
21 24.328, to carry out the requirements of this section.
22 Sec. 14b. (1) An interagency grant board is created,
23 consisting of the following members:
24 (a) Three members of the council designated by the
25 chairperson of the council.
26 (b) Three members of the commission on law enforcement
27 standards created in section 3 of the commission on law
1 enforcement standards act, 1965 PA 203, MCL 28.603, as designated
2 by the chairperson of the commission on law enforcement
3 standards.
4 (c) One rotating membership filled by the chairperson of the
5 council in each even numbered year and by the chairperson of the
6 commission on law enforcement standards in each odd numbered
7 year.
8 (2) The interagency grant board shall award grants to
9 eligible entities from the fire fighters training fund pursuant
10 to section 14a(1)(b).
11 Enacting section 1. Section 14 of the fire fighters
12 training council act of 1966, 1966 PA 291, MCL 29.314, is
13 repealed.
14 Enacting section 2. This amendatory act does not take
15 effect unless all of the following bills of the 92nd Legislature
16 are enacted into law:
