                                                                                 A bill to create the public safety training fund; and to                          

                                                                                

    provide for expenditures from the fund.                                     

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 1.  This act shall be known and may be cited as the                    

                                                                                

2   "public safety training fund act".                                          

                                                                                

3       Sec. 2.  (1) The public safety training fund is created in                  

                                                                                

4   the state treasury.  The money in the fund shall be used as                 

                                                                                

5   provided in section 3.                                                      

                                                                                

6       (2) The state treasurer shall credit to the public safety                   

                                                                                

7   training fund deposits of proceeds from the collection of                   

                                                                                

8   assessments imposed under section 452 of the insurance code of              

                                                                                

9   1956, 1956 PA 218, MCL 500.452, and shall credit all income from            

                                                                                

10  investment credited to the fund by the state treasurer.  The                

                                                                                

11  state treasurer may invest money in the fund in any manner                  

                                                                                

12  authorized by law for the investment of state money.  However, an           

                                                                                


                                                                                

1   investment shall not interfere with any apportionment,                      

                                                                                

2   allocation, or payment of money as required by this section.                

                                                                                

3       (3) The unencumbered balance remaining in the fund at the end               

                                                                                

4   of a fiscal year shall remain in the fund and shall not revert to           

                                                                                

5   the general fund.                                                           

                                                                                

6       Sec. 3.  In the state fiscal year beginning October 1, 2005                 

                                                                                

7   and in subsequent state fiscal years, the state treasurer shall             

                                                                                

8   distribute the proceeds of the fund on July 1 of each year as               

                                                                                

9   follows:                                                                    

                                                                                

10      (a) To the public safety officers benefit fund created in                   

                                                                                

11  section 3 of the public safety officers benefit act, 2004 PA 46,            

                                                                                

12  MCL 28.623, 0.25% of the fund balance.                                      

                                                                                

13      (b) To the prosecuting attorneys coordinating council created               

                                                                                

14  in section 4 of the prosecuting attorneys coordinating office act           

                                                                                

15  of 1972, 1972 PA 203, MCL 49.102, for use as prescribed in that             

                                                                                

16  act, 3% of the fund balance.                                                

                                                                                

17      (c) The balance remaining after the distributions under                     

                                                                                

18  subdivisions (a) and (b) shall be distributed as follows:                   

                                                                                

19                                                                               (i) One-half to the law enforcement officers training fund                          

                                                                                

20  created in section 13 of the commission on law enforcement                  

                                                                                

21  standards act, 1965 PA 203, MCL 28.613, for use as prescribed in            

                                                                                

22  section 14a of that act.                                                    

                                                                                

23      (ii) One-half to the fire fighters training fund created in                  

                                                                                

24  section 13 of the fire fighters training council act of 1966,               

                                                                                

25  1966 PA 291, MCL 29.373, for use as prescribed in section 14a of            

                                                                                

26  that act.                                                                   

                                                                                

27      Enacting section 1.  This act does not take effect unless                   


                                                                                

1   all of the following bills of the 92nd Legislature are enacted              

                                                                                

2   into law:                                                                   

                                                                                

3       (a) Senate Bill No. ________ or House Bill No. 6360
