A bill to amend 1965 PA 203, entitled
"Commission on law enforcement standards act,"
by amending section 13 (MCL 28.613) and by adding sections 14a
and 14b; and to repeal acts and parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 13. (1) There is created in the state treasury a law
2 enforcement officers
training fund. , from which, the
3 legislature shall
appropriate sums deemed necessary for the
4 purposes of this act.
5 (2) The state treasurer may receive money or other assets
6 from any source for deposit into the fund, including money
7 distributed to the fund from the public safety training fund
8 under section 3(c)(i) of the public safety training fund act.
9 The state treasurer shall direct the investment of the fund. The
10 state treasurer shall credit to the fund interest and earnings
1 from fund investments.
2 (3) Money in the fund at the close of the fiscal year shall
3 remain in the fund and shall not lapse to the general fund.
4 (4) Money in the fund shall be expended, upon appropriation,
5 as provided in section 14a.
6 Sec. 14a. (1) Money in the law enforcement officers
7 training fund shall be expended as follows:
8 (a) First the commission shall be reimbursed for the
9 administrative expenses of administering this act.
10 (b) Five percent of the money remaining after the
11 disbursement under subdivision (a) shall be expended for the
12 purpose of funding joint in-service training of, and facilitating
13 the collaboration of, personnel in law enforcement, fire service,
14 public emergency medical service, criminal prosecution and
15 courts, and emergency first responders, to prevent and respond to
16 accidents, natural disasters, and homeland security incidents.
17 The portion of the fund that is subject to this subsection shall
18 be distributed as grants to eligible entities, as provided in
19 section 14b.
20 (c) The balance of the money, after the disbursements under
21 subdivisions (a) and (b), shall be distributed on a reimbursement
22 basis to law enforcement agencies, for mandated in-service
23 training conducted during the previous year. The money shall be
24 distributed to law enforcement agencies based on the number of
25 full-time equated law enforcement officers certified by the
26 commission, at each law enforcement agency. An amount not
27 greater than 10% of the amount distributed to a law enforcement
1 agency may be expended for the purchase of equipment directly
2 related to in-service training.
3 (d) Money remaining in the fund after the disbursements under
4 subdivisions (a), (b), and (c) shall revert to the public safety
5 training fund created in the public safety training fund act for
6 distribution in future years and shall not revert to the general
7 fund or be used for any other purpose.
8 (2) The commission shall promulgate rules pursuant to the
9 administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to
10 24.328, to carry out the requirements of this section.
11 Sec. 14b. (1) An interagency grant board is created,
12 consisting of the following members:
13 (a) Three members of the commission designated by the
14 chairperson of the commission.
15 (b) Three members of the fire fighters training council
16 created in section 3 of the fire fighters training council act of
17 1966, 1966 PA 291, MCL 29.363, as designated by the chairperson
18 of the fire fighters training council.
19 (c) One rotating membership filled by the chairperson of the
20 fire fighters training council in each even numbered year and by
21 the chairperson of the commission in each odd numbered year.
22 (2) The interagency grant board shall award grants to
23 eligible entities from the law enforcement officers training fund
24 pursuant to section 14a(1)(b).
25 Enacting section 1. Section 14 of the commission on law
26 enforcement standards act, 1965 PA 203, MCL 28.614, is repealed.
27 Enacting section 2. This amendatory act does not take
1 effect unless all of the following bills of the 92nd Legislature
2 are enacted into law:
3 (a) Senate Bill No. ____ or House Bill No. 6360 (request
