A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending the heading of part 172 and section 17201 (MCL
324.17201), as added by 2002 PA 578, and by adding section
17205.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 PART 172. MERCURY
THERMOMETERS MERCURY-ADDED PRODUCTS
2 Sec. 17201. As used in this part:
3 (a) "Manufacturer" means a person that produces, imports, or
4 distributes mercury
thermometers a product in this state.
5 (b) "Mercury fever thermometer" means a mercury thermometer
6 used for measuring body temperature.
7 (c) "Mercury thermometer" means a product, or a component,
8 other than a dry cell battery, of a product, used for measuring
9 temperature that contains mercury or a mercury compound
1 intentionally added to the product or component.
2 (d) "Thermostat" means a device that regulates temperature in
3 an enclosed area by controlling heating, cooling, or ventilation
4 equipment.
5 Sec. 17205. (1) Beginning January 1, 2006, a manufacturer
6 of thermostats shall affix to each thermostat containing mercury
7 or a mercury compound intended for sale in this state or for use
8 in this state a label indicating that the device contains mercury
9 or a mercury compound and shall provide instructions with the
10 thermostat on the proper disposal of the thermostat and proper
11 cleanup of the mercury or mercury compound if a spill, leak, or
12 discharge occurs.
13 (2) Beginning January 1, 2010, a person shall not sell or
14 offer for sale a thermostat containing mercury or a mercury
15 compound in this state or for use in this state.
