                                                                                 A bill to amend 1994 PA 451, entitled                                             

                                                                                

    "Natural resources and environmental protection act,"                       

                                                                                

    by amending section 30903 (MCL 324.30903), as added by 1995 PA              

                                                                                

    59.                                                                         

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 30903. (1) The lake board shall consist of all of the                  

                                                                                

2   following:                                                                  

                                                                                

3       (a) A member of the county board of commissioners appointed                 

                                                                                

4   by the chairperson of the county board of commissioners of each             

                                                                                

5   county affected by the lake improvement project; a representative           

                                                                                

6   of each local unit of government appointed by the legislative               

                                                                                

7   body of each local unit of government, other than a county,                 

                                                                                

8   affected by the project; and the county drain commissioner, or a            

                                                                                

9   member of the county road commission in counties not having a               

                                                                                

10  drain commissioner.  ; and a representative of the department.              

                                                                                


                                                                                

1       (b) A member elected by the members of the lake board serving               

                                                                                

2   pursuant to subdivision (a) at the first meeting of the board or            

                                                                                

3   at any time a vacancy exists under this subdivision.  Only a                

                                                                                

4   person who has an interest in a land contract or a record                   

                                                                                

5   interest in the title to a piece or parcel of land that abuts the           

                                                                                

6   lake to be improved is eligible to be elected and to serve under            

                                                                                

7   this subdivision.  An organization composed of and representing             

                                                                                

8   the majority of lakefront property owners on the affected lake              

                                                                                

9   may submit up to 3 names to the board, from which the board shall           

                                                                                

10  make its selection.  The terms served by this member shall be 4             

                                                                                

11  years in length.                                                            

                                                                                

12      (2) The lake board shall elect a chairperson and a                          

                                                                                

13  secretary.  A majority of the members of the lake board                     

                                                                                

14  constitutes a quorum.  The concurrence of a majority  in any                

                                                                                

15  matter within the duties  of the members of the board  shall be             

                                                                                

16  is required for  the determination of a matter  action by the               

                                                                                

17  board.                                                                      

                                                                                

18      (3) The department, upon request of the lake board, shall                   

                                                                                

19  provide whatever technical data it has available and make                   

                                                                                

20  recommendations in the interests of conservation.
