A bill to amend 1921 PA 207, entitled
"City and village zoning act,"
(MCL 125.581 to 125.600) by adding section 3d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 3d. (1) The legislative body of a city or village may
2 provide by ordinance restrictions on the location of and distance
3 between businesses that are licensed to sell alcoholic beverages
4 at retail and establishments that provide entertainment involving
5 nudity.
6 (2) A city or village may purchase, condemn, or otherwise
7 acquire private property or an interest in private property for
8 the removal of nonconforming uses and structures that existed at
9 the time an ordinance under this section is enacted.
10 (3) The elimination of nonconforming uses and structures
11 under this section is declared to be for a public purpose.
1 (4) As used in this section, "nudity" means that term as
2 defined in section 916 of the Michigan liquor control code of
3 1998, 1998 PA 58, MCL 436.1916.
