                                                                                 A bill to amend 1943 PA 184, entitled                                             

                                                                                

    "Township zoning act,"                                                      

                                                                                

    by amending section 24 (MCL 125.294), as amended by 1994 PA 24.             

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 24.  (1) A use of land, or the use, erection,                          

                                                                                

2   alteration, razing, or conversion of a dwelling, building, or               

                                                                                

3   other structure, including a tent or trailer coach,  used,                  

                                                                                

4   erected, altered, razed, or converted  in violation of  a local             

                                                                                

5   ordinance or regulation adopted pursuant to  an ordinance adopted           

                                                                                

6   under this act is a nuisance per se.  The court shall order the             

                                                                                

7   nuisance abated and the owner or agent in charge of the                     

                                                                                

8   dwelling, building, structure, tent, trailer coach  , or  land             

                                                                                

9   or dwelling, building, or other structure is liable for                     

                                                                                

10  maintaining a nuisance per se.   The township board shall in the            

                                                                                

11  ordinance enacted under this act designate the proper                       

                                                                                


                                                                                

1       (2) The zoning ordinance shall designate the official or                    

                                                                                

2   officials who shall administer and enforce  that  the ordinance.            

                                                                                

3   and do either of the following for                                         

                                                                                

4       (3) For each violation of the  ordinance:  (a) Impose a                     

                                                                                

5   penalty for the violation.  (b) Designate  zoning ordinance, the            

                                                                                

6   ordinance shall impose a penalty, or shall designate the                    

                                                                                

7   violation as a municipal civil infraction and impose a civil                

                                                                                

8   fine.  for the violation.  A criminal or civil fine imposed for a           

                                                                                

9   violation of a zoning ordinance, whether a first, subsequent, or            

                                                                                

10  continuing violation, shall not exceed $10,000.00.
