A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 11514 (MCL 324.11514) and by adding section
11514a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11514. A person shall not knowingly dispose of, and an
2 owner or operator of a landfill shall not knowingly permit the
3 disposal of , medical
waste in a landfill any of the following
4 in a landfill:
5 (a) Medical waste, unless that medical waste has been
6 decontaminated or is not required to be decontaminated but is
7 packaged in the manner required under part 138 of the public
8 health code, Act No.
368 of the Public Acts of 1978, being
9 sections 333.13801 to
333.13831 of the Michigan Compiled Laws
10 1978 PA 368, MCL 333.13801 to 333.13831.
1 (b) A beverage container.
2 (c) A whole motor vehicle tire.
3 (d) Used oil as defined in section 16701.
4 (e) A lead acid battery as defined in section 17101.
5 (f) Low-level radioactive waste as defined in section 2 of
6 the low-level radioactive waste authority act, 1987 PA 204, MCL
7 333.26202.
8 (g) Hazardous waste that is required to be disposed of in a
9 hazardous waste treatment, storage, or disposal facility under
10 part 111.
11 Sec. 11514a. (1) At the time that a person disposes of
12 solid waste at a landfill, the person shall certify in writing
13 that, to the best of his or her knowledge, the solid waste does
14 not contain any item or substance that is prohibited from
15 disposal in a landfill as provided in this part or the rules
16 promulgated under this part.
17 (2) The department shall provide certification forms to the
18 owners and operators of landfills in this state. The owner or
19 operator of a landfill shall forward to the department the
20 certifications he or she receives under this section.
21 Enacting section 1. This amendatory act does not take
22 effect unless all of the following bills of the 92nd Legislature
23 are enacted into law:
24 (a) Senate Bill No. _____ or House Bill No. 4692 (request

26 (b) Senate Bill No. _____ or House Bill No. 4690 (request
27 no. 03687'03).
1 (c) Senate Bill No. _____ or House Bill No. 4691 (request
