A bill to amend 1927 PA 372, entitled
"An act to regulate and license the selling, purchasing,
possessing, and carrying of certain firearms and gas ejecting
devices; to prohibit the buying, selling, or carrying of certain
firearms and gas ejecting devices without a license or other
authorization; to provide for the forfeiture of firearms under
certain circumstances; to provide for penalties and remedies; to
provide immunity from civil liability under certain
circumstances; to prescribe the powers and duties of certain
state and local agencies; to prohibit certain conduct against
individuals who apply for or receive a license to carry a
concealed pistol; to make appropriations; to prescribe certain
conditions for the appropriations; and to repeal all acts and
parts of acts inconsistent with this act,"
by amending section 5n (MCL 28.425n), as added by 2000 PA 381.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 5n. (1) This state or a local unit of government of
2 this state shall not prohibit an individual from doing either of
3 the following as a condition for receiving or maintaining any
4 other license or permit authorized by law:
5 (a) Applying for or receiving a license to carry a concealed
1 pistol under this act.
2 (b) Carrying a concealed pistol in compliance with a license
3 issued under this act.
4 (2) Except as
provided in subsection subsections (3) and
5 (4), an employer shall not prohibit an employee from doing either
6 of the following:
7 (a) Applying for or receiving a license to carry a concealed
8 pistol under this act.
9 (b) Carrying a concealed pistol in compliance with a license
10 issued under this act. This subdivision does not prohibit an
11 employer from prohibiting an employee from carrying a concealed
12 pistol in the course of his or her employment with that
13 employer.
14 (3) A police agency may prohibit an employee of that police
15 agency from carrying a concealed pistol if carrying a concealed
16 pistol would result in increased insurance premiums or a loss or
17 reduction of insurance coverage for that employer.
18 (4) Notwithstanding subsection (2)(b), and subject to
19 subsection (3), an employee of this state or a political
20 subdivision of this state who, in the course of his or her
21 employment, is required to perform inspections on private
22 property may carry a concealed pistol while on that private
23 property if he or she is licensed under this act.
