A bill to amend 1980 PA 350, entitled
"The nonprofit health care corporation reform act,"
(MCL 550.1101 to 550.1704) by adding section 418a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 418a. (1) A health care corporation certificate
2 delivered, issued for delivery, or renewed in this state that
3 provides benefits for medical transportation services shall
4 provide for direct reimbursement to any provider of covered
5 medical transportation services if that provider has not received
6 payment for those services from any other source.
7 (2) Subsection (1) does not apply to a transaction between a
8 health care corporation and a medical transportation service
9 provider if the parties have entered into a contract providing
10 for direct payment.
11 (3) Subsection (1) is satisfied if a member files a claim for
1 the medical transportation service with the health care
2 corporation, the health care corporation pays the medical
3 transportation service provider directly, and the medical
4 transportation service provider does not demand payment from the
5 member until receiving payment from the health care corporation,
6 after which the medical transportation service provider may
7 demand payment from the member for any unpaid portion of the
8 provider fee.
9 Enacting section 1. This amendatory act takes effect
10 January 1, 2004.
