A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 707c (MCL 257.707c).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 707c. (1) After
April 1, 1978, a A motor vehicle
2 shall not be operated or driven on a highway or street if the
3 motor vehicle produces total noise exceeding 1 of the following
4 limits at a distance of 50 feet except as provided in
5 subdivisions (b)(iii) and (c)(iii):
6 (a) A motor vehicle with a gross weight or gross vehicle
7 weight rating of 8,500 pounds or more, combination vehicle with
8 gross weight or gross vehicle weight ratings of 8,500 pounds or
9 more.
10 (i) Ninety DBA if the maximum lawful speed on the highway or
11 street is greater than 35 miles per hour.
1 (ii) Eighty-six DBA if the maximum lawful speed on the
2 highway or street is not more than 35 miles per hour.
3 (iii) Eighty-eight DBA under stationary run-up test.
4 (b) A motorcycle or a moped:
5 (i) Eighty-six DBA if the maximum lawful speed on the
6 highway or street is greater than 35 miles per hour.
7 (ii) Eighty-two DBA if the maximum lawful speed on the
8 highway or street is not more than 35 miles per hour.
9 (iii) Ninety-five DBA under stationary run-up test at 75
10 inches.
11 (c) A motor vehicle or a combination of vehicles towed by a
12 motor vehicle not covered in subdivision (a) or (b):
13 (i) Eighty-two DBA if the maximum lawful speed on the
14 highway or street is greater than 35 miles per hour.
15 (ii) Seventy-six DBA if the maximum lawful speed on the
16 highway or street is not more than 35 miles per hour.
17 (iii) Ninety-five DBA under stationary run-up test 20 inches
18 from the end of the tailpipe.
19 (2) A dealer shall not sell or offer for sale for use upon a
20 street or highway in this
state a new motor vehicle manufactured
21 after April 1, 1978,
which that produces a maximum
noise
22 exceeding the following limits:
23 (a) A motor vehicle with a gross vehicle weight rating of
24 8,500 pounds or more--83 DBA.
25 (b) A motorcycle or a
moped-- 83 80 DBA.
26 (c) A motor vehicle not covered in subdivision (a) or
27 (b)--80 DBA.
1 (3) A person shall not operate a vehicle on a highway or
2 street if the vehicle has a defect in the exhaust system which
3 affects sound reduction, is not equipped with a muffler or other
4 noise dissipative device, or is equipped with a cutout, bypass,
5 amplifier, or a similar device.
6 (4) A person, either acting for himself or herself or as the
7 agent or employee of another, shall not sell, install, or replace
8 a muffler or exhaust part that causes the motor vehicle to which
9 the muffler or exhaust part is attached to exceed the noise
10 limits established by this act or a rule promulgated under this
11 act.
12 (5) A person shall not modify, repair, replace, or remove a
13 part of an exhaust system causing the motor vehicle to which the
14 system is attached to produce noise in excess of the levels
15 established by this act, or operate a motor vehicle so altered on
16 a street or highway.
17 (6) A dealer shall not sell a used or secondhand motor
18 vehicle for use upon a street or highway which is not in
19 compliance with this act.
