A bill to amend 1976 PA 331, entitled
"Michigan consumer protection act,"
(MCL 445.901 to 445.922) by adding section 903e.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 903e. (1) A person shall not sell or offer to sell a
2 disposable cellular telephone in this state.
3 (2) A person who violates this section is subject to a civil
4 fine of not less than $250.00 for each violation.
5 (3) As used in this section:
6 (a) "Cellular telephone service supplier" means a person
7 engaged in trade or commerce who provides cellular telephone
8 service.
9 (b) "Disposable cellular telephone" means a cellular mobile
10 radio telephone or other radio telephone that meets all of the
11 following:
1 (i) Does not require an access line for service.
2 (ii) Is designed and marketed for use only for a fixed
3 period, for which a cellular telephone service supplier provides
4 prepaid calling services.
5 (iii) Cannot receive incoming calls.
