A bill to establish the Michigan disability sports alliance
fund in the department of community health; to provide for the
distribution of money from the fund; to prescribe the duties and
powers of certain agencies and officials; and to provide for
appropriations.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. This act shall be known and may be cited as the
2 "Michigan disability sports alliance fund act".
3 Sec. 2. As used in this act:
4 (a) "Department" means the department of community health.
5 (b) "Fund" means the Michigan disability sports alliance fund
6 created in section 3.
7 Sec. 3. (1) The Michigan disability sports alliance fund is
8 created in the department to provide funds to do both of the
9 following:
1 (a) Promote and enhance the development of sports
2 opportunities for individuals with physical disabilities.
3 (b) Educate the general public about the importance of sports
4 opportunities for individuals with physical disabilities.
5 (2) The state treasurer shall credit to the fund all amounts
6 appropriated for this purpose under section 438 of the income tax
7 act of 1967, 1967 PA 281, MCL 206.438.
8 (3) The fund shall consist of the money credited to the fund
9 pursuant to section 438 of the income tax act of 1967, 1967 PA
10 281, MCL 206.438, any interest and earnings accruing from the
11 saving and investment of that money, and other appropriations,
12 money, or other things of value received by the fund.
13 (4) The state treasurer shall direct the investment of the
14 fund.
15 (5) Money in the fund at the close of the year shall remain
16 in the fund and shall not lapse to the general fund.
17 Sec. 4. (1) The money, interest, and earnings of the fund
18 shall be expended solely for the purposes described in this act.
19 (2) Money granted or received as a gift or donation to the
20 fund is available for distribution upon appropriation.
21 Sec. 5. The department shall provide grants to
22 organizations that are exempt from taxation under section
23 501(c)(3) of the internal revenue code that have experience in
24 providing and supporting sports opportunities to individuals with
25 physical disabilities to do all of the following with the money
26 from the fund:
27 (a) Support and host a statewide annual sporting competition
1 for individuals with physical disabilities.
2 (b) Promote local and regional sporting competitions for
3 individuals with physical disabilities.
4 (c) Provide information to the public about the value of
5 sporting events for individuals with physical disabilities.
6 (d) Develop and publicize criteria for proposals to be funded
7 under this act.
8 Sec. 6. (1) The department shall seek and approve proposals
9 from organizations that qualify to receive money from the fund
10 and determine which proposals to fund under this act. The
11 department shall only approve and fund proposals from
12 individuals, groups, and institutions that have interest and
13 experience in providing sporting opportunities for individuals
14 with physical disabilities.
15 (2) The department shall review and approve proposals
16 submitted for funding under this act and shall give priority to
17 proposals submitted by applicants that are located in this state
18 and that conduct sporting activities in this state.
19 Sec. 7. The money in the fund that is available for
20 distribution shall be appropriated each year.
21 Enacting section 1. This act does not take effect unless
22 Senate Bill No. _______ or House Bill No. 4301 (request
23 no. 02270'03) of the 92nd Legislature is enacted into law.
