SUBSTITUTE FOR

SENATE BILL NO. 861

                                                                             A bill to amend 1994 PA 451, entitled                                             

"Natural resources and environmental protection act,"                       

(MCL 324.101 to 324.90106) by adding section 17305.                         

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1   Sec. 17305.  (1) The goal for waste recycling volumes in                    

2   this state is 27% by July 1, 2009.                                          

3       (2) By July 1 of each year, the department shall provide a                  

4   report to the standing committees of both houses of the                     

5   legislature with jurisdiction over matters primarily relating to            

6   natural resources and the environment.  The report shall contain            

7   both of the following for this state for the previous year:                 

8       (a) Waste diversion volumes.                                                

9   (b) Recycling rates.                                                        

10      (3) In reporting waste diversion and recycling rates under                  

11  this section, the department shall use a methodology for                    

1   measuring rates that is consistent with methodology developed by            

2   the United States environmental protection agency as a guide for            

3   state and local governments.
