SUBSTITUTE FOR

SENATE BILL NO. 390

                                                                             A bill to amend 1974 PA 93, entitled                                              

"An act to license and regulate horse riding stables and sales              

barns; to prescribe the duties of the department of agriculture;            

and to provide a penalty,"                                                  

by amending section 3 (MCL 287.113).                                        

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1       Sec. 3.  (1) The department shall require  applicants an                   

2   applicant for license to furnish  such  information  as  it                 

3   deems considers necessary to determine that the  applicants               

4   are applicant is of good reputation and character,  are

5   adequately financed to carry out the business that  they intend

6   it intends to pursue, and  are  sufficiently knowledgeable in the           

7   business.  The department may conduct  such  further                        

8   investigation and require  such  further information  as that it           

9   deems considers necessary to establish the sufficiency of the             

10  application.                                                                

1   (2)  Upon making Before October 1, 2003 or after September                 

2   30, 2007 and upon filing an application,  each the applicant               

3   shall pay a fee of  $25.00 for each license and such $25.00 for            

4   each license.  Beginning October 1, 2003 through September 30,              

5   2007, the applicant shall pay a fee of $100.00 for each license.            

6   The revenue shall be deposited in the general fund.                         

7   (3) The  department shall thereupon issue a  license  ,                     

8   which  shall be displayed prominently in the licensee's place of            

9   business.  An applicant shall  be required to  obtain a separate            

10  license for each business location.  Licenses are not                       

11  transferable and expire on the following January 1.   A

12  (4) Before October 1, 2003 or after September 30, 2007, a

13  licensee may renew his or her license upon paying a renewal fee             

14  of  $25.00 and such $25.00.  Beginning October 1, 2003 through             

15  September 30, 2007, the renewal fee is $50.00.  The revenue shall           

16  be deposited in the general fund.
